SNAP Citizenship and Residency Act of 2026

To amend the Food and Nutrition Act of 2008 to restrict the eligibility of aliens to receive supplemental nutrition assistance program benefits to aliens admitted to the United States as lawful permanent residents and who thereafter lawfully reside in the United States for at least 10 years.

1. Short title

This Act may be cited as the “SNAP Citizenship and Residency Act of 2026”.

2. Limitation on eligibility of aliens for SNAP

Section 5 of the of the Food and Nutrition Act of 2008 (7 U.S.C. 2016) is amended by adding at the end the following:

(o) Limitation on eligibility of aliens
Notwithstanding any other provision of law, no individual who is a member of a household otherwise eligible to participate in the supplemental nutrition assistance program under this Act shall be eligible to participate in such program as a member of that or any other household unless such individual is an alien lawfully admitted for permanent residence as an immigrant (as defined by sections 101(a)(15) and 101(a)(20) of the Immigration and Nationality Act) and has lawfully resided in the United States for a 10-year period beginning on the date of being so admitted.
