(BDR 5-295)FISCAL NOTE: Effect on Local Government: No.Effect on the State: No.~EXPLANATION – Matter in bolded italics is new; matter between brackets [omitted material] is material to be omitted.AN ACT relating to juvenile justice; revising the term length andmembership of the Juvenile Justice OversightCommission; and providing other matters properlyrelating thereto.Legislative Counsel’s Digest:1 The federal Juvenile Justice and Delinquency Prevention Act of 1974 provides2 federal funding to states to develop programs in the area of juvenile delinquency3 and to improve the juvenile justice system. To be eligible for certain federal grants4 under the Act, a state must submit to the Administrator of the Office of Juvenile5 Justice and Delinquency Prevention within the United States Department of Justice6 a plan that provides for an advisory group which consists of certain members7 appointed by the chief executive officer of the state. (34 U.S.C. § 11133) To8 comply with this eligibility requirement, existing state law establishes the Juvenile9 Justice Oversight Commission and prescribes specific qualifications for10 membership on the Commission. (NRS 62B.600) Section 1 of this bill replaces11 certain requirements concerning the number of members of the Commission and12 the qualifications for membership on the Commission with a requirement that the13 membership of the Commission must comply with the requirements of the Act.14 Section 1 also increases the term of members of the Commission from 2 years to 415 years. Section 2 of this bill: (1) provides that the term of each existing member of16 the Commission expires on October 1, 2025; and (2) requires the Governor to17 appoint new members to the Commission.- *AB7*–2–THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED INSENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:1 Section 1. NRS 62B.600 is hereby amended to read as2 follows:3 62B.600 1. The Juvenile Justice Oversight Commission is4 hereby established.5 2. The Commission consists of the Governor or his or her6 designee and [25] members appointed by the Governor. The7 [Governor shall appoint to] membership of the Commission [:8 (a) Two members nominated by the Senate, who are not9 members of the Senate or public officers.10 (b) Two members nominated by the Assembly, who are not11 members of the Assembly or public officers.12 (c) Two members nominated by the Supreme Court, who are not13 judges, justices or public officers.14 (d) The Administrator of the Division of Child and Family15 Services or his or her designee.16 (e) The Deputy Administrator of Juvenile Services of the17 Division of Child and Family Services or his or her designee.18 (f) Three members who are directors of juvenile services, one19 each of whom must represent a county whose population:20(1) Is less than 100,000.21(2) Is 100,000 or more but less than 700,000.22(3) Is 700,000 or more.23 (g) Two members who are district attorneys.24 (h) Two members who are public defenders.25 (i) One member who is a representative of a law enforcement26 agency.27 (j) Two members who are representatives of a nonprofit28 organization which provides programs to prevent juvenile29 delinquency.30 (k) One member who is a volunteer who works with children31 who have been adjudicated delinquent.32 (l) Six members who are under the age of 24 years at the time of33 appointment.] must comply with the requirements prescribed by 3434 U.S.C. § 11133(a)(3)(A).35 3. [At least three of the persons appointed to the Commission36 pursuant to subsection 2 must be persons who are currently or were37 formerly subject to the jurisdiction of the juvenile court.38 4.] Each appointed member serves a term of [2] 4 years.39 Members may be reappointed for additional terms of [2] 4 years in40 the same manner as the original appointments. Any vacancy41 occurring in the membership of the Commission must be filled in42 the same manner as the original appointment not later than 30 days- *AB7*–3–1 after the vacancy occurs. [Nine of the initial members of the2 Commission who are appointed pursuant to subsection 2 must be3 appointed to an initial term of 1 year.] Each member of the4 Commission continues in office until his or her successor is5 appointed.6 [5.] 4. The members of the Commission serve without7 compensation but are entitled to receive the per diem allowance and8 travel expenses provided for state officers and employees generally.9 [6.] 5. A majority of the members of the Commission10 constitutes a quorum for the transaction of business, and a majority11 of a quorum present at any meeting is sufficient for any official12 action taken by the Commission.13 [7.] 6. A member of the Commission who is an officer or14 employee of this State or a political subdivision of this State must be15 relieved from his or her duties without loss of regular compensation16 to prepare for and attend meetings of the Commission and perform17 any work necessary to carry out the duties of the Commission in the18 most timely manner practicable. A state agency or political19 subdivision of this State shall not require an officer or employee20 who is a member of the Commission to:21 (a) Make up the time he or she is absent from work to carry out22 his or her duties as a member of the Commission; or23 (b) Take annual leave or compensatory time for the absence.24 [8.] 7. At the first meeting of the Commission and annually25 thereafter:26 (a) The Governor shall appoint a Chair of the Commission;27 (b) The Commission shall elect a Secretary from among its28 members; and29 (c) The Commission shall adopt rules for its own management30 and government.31 [9.] 8. The Commission shall [:32 (a) Hold its first meeting within 60 days after all the initial33 appointments to the Commission are made pursuant to subsection 2;34 and35 (b) Meet] meet at least once every 4 months and may meet at36 such further times as deemed necessary by the Chair.37 [10. As used in this section, “public officer” has the meaning38 ascribed to it in NRS 205.4627.]39 Sec. 2. 1. The terms of the members of the Juvenile Justice40 Oversight Commission appointed pursuant to NRS 62B.600 who are41 incumbent on October 1, 2025, expire on that date.- *AB7*–4–1 2. As soon as practicable on or after October 1, 2025, the2 Governor shall appoint members to the Commission in accordance3 with the provisions of NRS 62B.600, as amended by section 1 of4 this act.H- *AB7*
