4 Subject: Alcoholic beverages; licensing; retail licenses and permits;
5miscellaneous amendments
6 Statement of purpose of bill as introduced: This bill proposes to:
7(1) authorize the holder of a fourth-class license to sell its products to
8 not more than eight additional manufacturers or rectifiers; and
9(2) authorize manufacturers of malt beverages to acquire a retail
10 shipping license and ship malt beverages to first- and second-class licensees.
11    An act relating to miscellaneous amendments to the statutes governing
12    alcoholic beverages
13 It is hereby enacted by the General Assembly of the State of Vermont:
14 Sec. 1. 7 V.S.A. § 224 is amended to read:
15 § 224. FOURTH-CLASS LICENSES

17    (c)(1) At only one fourth-class license location, a licensed manufacturer or
18 rectifier may sell by the unopened container or distribute by the glass, with or
19 without charge, alcoholic beverages produced by no not more than five eight

1 additional manufacturers or rectifiers, provided these beverages are purchased
2 on invoice from the manufacturer or rectifier.
3(2) A manufacturer or rectifier may sell its product to no not more than
4 five eight additional manufacturers or rectifiers.

6 Sec. 2. 7 V.S.A. § 278 is amended to read:
7 § 278. VINOUS BEVERAGE AND MALT BEVERAGE RETAIL
8SHIPPING LICENSE
9    (a) A manufacturer or rectifier of vinous beverages or malt beverages that
10 is licensed in the State or outside the State and holds valid state and federal
11 permits and operates a winery or brewery in the United States may apply for a
12 retail shipping license by filing with the Division of Liquor Control an
13 application in a form required by the Commissioner accompanied by a copy of
14 its in-state or out-of-state license and the fee provided in section 204 of this
15 title.

17    (c) A retail shipping license holder, including the holder’s affiliates,
18 franchises, and subsidiaries, may sell up to 5,000 gallons of vinous beverages
19 or malt beverages per year directly to first- or second-class licensees and
20 deliver the beverages by common carrier, the manufacturer’s or rectifier’s own
21 vehicle, or the vehicle of an employee of a manufacturer or rectifier, provided

1 that the beverages are sold on invoice, and no not more than 100 gallons per
2 month are sold to any single first- or second-class licensee.

4    (e) Vinous beverages or malt beverages sold under this section may be
5 delivered by the vehicle of a second-class license holder if the second-class
6 licensee cannot obtain the vinous beverages or malt beverages from a
7 wholesale dealer.
8 Sec. 3. EFFECTIVE DATE
9    This act shall take effect on July 1, 2025.
