The Illinois Insurance Code is amended by5 adding Section 370c.5 as follows:6 (215 ILCS 5/370c.5 new)7 Sec. 370c.5. Disability income insurance mental health and8 substance use disorder coverage disclosure.9 (a) No group or individual policy or contract of long-term10 disability income insurance in this State that limits the11 duration of coverage for mental health and substance use12 disorders shall be offered without a disclosure, provided at13 the time of application, that includes a notification stating14 that:15 (1) the long-term disability coverage selected by the16 potential policyholder or plan sponsor limits the duration17 of coverage for mental health or substance use disorders;18 and19 (2) the potential policyholder or plan sponsor has the20 right to request more information about the limitation and21 other coverage options that include an unlimited duration,22 if available.23 (b) Receipt of the disclosure described in subsection (a)SB1327 Enrolled - 2 - LRB104 10928 BAB 21010 b1 must be acknowledged by the potential policyholder or plan2 sponsor, and evidence of the disclosure and acknowledgment3 must be retained by the insurance company offering the4 coverage.5 Section 99. Effective date. This Act takes effect January6 1, 2028.
Amends the Illinois Insurance Code. Provides that, on and after January 1, 2028, no insurer shall amend, deliver, issue, or renew a group or individual policy or certificate of long-term disability income insurance in the State without a disclosure, provided at the time of application, that includes the specified information concerning limitations on the duration of coverage for mental health or substance use disorders and the right to request more information about the limitation and other coverage options. Requires receipt of the disclosure to be acknowledged by the potential policyholder or plan sponsor, and provides that evidence of the disclosure and acknowledgment must be retained by the insurance company offering the coverage for a period of no less than 2 years. Effective January 1, 2028.
