Section 4001 etseq.)."Floodway" means an area that is identified on the floodinsurance rate map as a regulatory floodway, which includes thechannel of a river or other watercourse and the adjacent land areasthat must be reserved for the discharge of a base flood, alsoreferred to as a 100-year flood, without cumulatively increasingthe water surface elevation more than a designated height."Reservoir" means a water impoundment project operated by theUnited States Army Corps of Engineers that is intended to retainwater or delay the runoff of water in a designated surface area ofland.7. Have you (Seller) ever filed a claim for flood damage to theproperty with any insurance provider, including the National FloodInsurance Program (NFIP)?* __ Yes __ No. If yes, explain (attachadditional sheets as necessary):*Homes in high risk flood zones with mortgages from federallyregulated or insured lenders are required to have floodinsurance. Subchapter A, Chapter 5, Property Code, isamended by adding Section 5.0131 to read as follows:Sec. 5.0131. NOTICE OF GROUNDWATER AND SURFACE WATERRIGHTS. (a) This section applies only to the sale of a fee simpleinterest in residential real property located in this statecomprising not more than one dwelling unit and land on which thedwelling is located.(b) A seller of residential real property to which thissection applies shall provide the purchaser of the property with awritten notice describing the groundwater and surface water rightsconveyed with the property.(c) The Texas Real Estate Commission shall develop andpublish the form for the written notice required under Subsection(b). The form must require the seller to disclose informationconcerning:(1) whether the conveyance of the property includesany groundwater rights;(2) whether the conveyance of the property includesany surface water rights;(3) whether there are any water wells located on theproperty; and(4) if the property is located in a groundwaterconservation district or a subsidence district, the name and anyrelevant information concerning the applicable district.(d) The notice must be delivered by the seller on or beforethe effective date of an executory contract binding the purchaserto purchase the property. If a contract is entered without theseller providing the notice as required by this section, thepurchaser may terminate the contract for any reason not later thanthe seventh day after the effective date of the receiving of thenotice.(e) The appropriate use of forms published by the Texas RealEstate Commission under this section constitutes compliance withthis section.SECTION 3. Section 5.008(b), Property Code, as amended bythis Act, and Section 5.0131, Property Code, as added by this Act,apply only to a transfer of property that occurs on or after theeffective date of this Act. A transfer of property that occursbefore the effective date of this Act is governed by the lawapplicable to the transfer immediately before that date, and theformer law is continued in effect for that purpose. For thepurposes of this section, a transfer of property occurs before theeffective date of this Act if the contract binding the purchaser topurchase the property is executed before that date.SECTION 4. This Act takes effect September 1, 2025.
