Pursuant to the provisions and subject to all5of the terms and conditions of this Act, the Director of6Corrections, on behalf of the State of Illinois, is authorized7to execute and deliver to the Forest Preserve District of Will8County, Illinois, for and in consideration of $1 paid to the9Department of Corrections, a quitclaim deed to the following10described real property and a quitclaim bill of sale to all the11existing tangible personal property on that real property, and12such ancillary documents as appropriate for fully and properly13effectuating a transfer to the Forest Preserve District of14Will County, Illinois of the title to the land generally15described as follows, and as may change if jointly agreed by16the Forest Preserve District of Will County, Illinois and17Department of Corrections as provided for in Section 25:18 LOTS 1, 2, 3 AND 11 (EXCEPT THEREFROM THE E. SAID PARCEL2 CONTAINING 149.209 ACRES, MORE OR LESS.3 Section 10. Conveyance. Upon the payment of the sum of $14to the Department of Corrections, and subject to the5conditions set forth herein, the Director of Corrections, on6behalf of the State of Illinois and the Department of7Corrections, shall convey by quitclaim deed, quitclaim bill of8sale, and ancillary documents all rights, title, and interest9of the State of Illinois and the Department of Corrections in10and to the real property described in Section 5, and all11tangible personal property on that property, to the Forest12Preserve District of Will County, Illinois. The Forest13Preserve District of Will County, Illinois shall bear all14costs associated with the conveyance and generally associated15with the transfer.16 The conveyance of real property and tangible personal17property authorized by Section 5 shall be made subject to: (i)18existing public or quasi-public utilities, existing public19roads, and any and all reservations, easements, encumbrances,20licenses, covenants, and restrictions of record; and (ii) the21express condition that if said real property ceases to be used22for public purposes, including recreation and conservation, it23shall revert to the State of Illinois, Department of24Corrections.25 Each of the documents of transfer shall be subject to theSB1698 Engrossed - 5 - LRB104 02995 LNS 13013 b1condition that the property shall be used for public purposes2only, including recreation and conservation, and shall so3state on its face. Each of the documents of transfer shall4contain an automatic reverter clause providing that title to5the property shall revert, without further action, to the6State of Illinois if: (i) the property is used for any purpose7other than a public purpose; or (ii) an attempt is made to sell8the property or convey or transfer or donate the property. If9the property reverts to the Department of Corrections, then10the Forest Preserve District of Will County, Illinois shall11reimburse the Department of Corrections for legal fees to12complete the conveyance and shall bear all other costs13associated with the conveyance.14 Section 15. Recording. The Director of Corrections shall15obtain a certified copy of this Act within 60 days after its16effective date. The Department of Corrections shall ensure17that a certified copy of this Act and any quitclaim deed18executed pursuant to this Act that is provided to the Forest19Preserve of Will County, Illinois, shall be recorded by the20Forest Preserve of Will County, Illinois, in the Recorder's21Office of the county in which the land is located.22 The transfer of title authorized under this Act shall be23by quitclaim deed and quitclaim bill of sale, which shall be24prepared by the Department of Corrections so that the transfer25is on an "AS IS", "WHERE IS", and "WITH ALL FAULTS" basis as ofSB1698 Engrossed - 6 - LRB104 02995 LNS 13013 b1the date of transfer, without any representation by the State2of Illinois to the Forest Preserve District of Will County,3Illinois as to the property's condition or fitness for any4purpose. Both the deed and bill of sale shall be executed by5the Forest Preserve District of Will County, Illinois as6grantee in order to confirm the Forest Preserve District of7Will County, Illinois' undertakings to abide by the8requirements in this Act. All documents of transfer shall be9recorded by the Forest Preserve District of Will County,10Illinois in the county in which the property is located and a11copy of the recordation provided to the Department of12Corrections immediately following recordation.13 Section 20. Condition for conveyance. The conveyance of14real property authorized by Section 5 shall be made subject to15the express conditions that the Forest Preserve District of16Will County, Illinois shall obtain an ALTA survey describing17the land to be transferred sufficiently and an appraisal of18the land and shall supply a copy of the ALTA survey and19appraisal to the Department of Corrections and the Department20of Central Management Services for review to ensure that the21correct land will be transferred. The conveyance of property22authorized by Section 5 shall occur only after the Forest23Preserve District of Will County, Illinois has provided the24Director and the Department with the ALTA Survey accurately25describing the land to be transferred and the appraisal.SB1698 Engrossed - 7 - LRB104 02995 LNS 13013 b1 Section 25. Change of legal description. If the Forest2Preserve District of Will County, Illinois and the Department3of Corrections jointly agree to reduce the size of the4transfer and jointly agree on a new legal description to the5transferred property within the boundaries described in6Section 5, then the Director of the Department of Corrections7is authorized to execute such documentation as provided in8this Act with the jointly agreed upon legal description.9 Section 99. Effective date. This Act takes effect July 1,102026.
Reinserts the provisions of the introduced bill with the following changes. Authorizes the conveyance to be completed by the Director of Corrections (rather than the Director of Central Management Services) on behalf of the State and the Department of Corrections (rather than the Department of Central Management Services). Provides for the execution of a quitclaim bill of sale and certain ancillary documents. Provides that the authorized conveyance of property shall be made subject to the express condition that the Forest Preserve District of Will County, Illinois, shall obtain an ALTA survey and appraisal of the property and supply a copy of the survey and appraisal to the Department of Corrections and the Department of Central Management Services for review to ensure that the correct parcels of land will be transferred. Provides that the Forest Preserve District of Will County, Illinois and the Department of Corrections may jointly agree to reduce the size of the transfer and jointly agree on a new legal description to the transferred property within the boundaries described in the Act. Effective July 1, 2026.
