8 Subject: Conservation and development; land use; Act 250; land use permits;
9exemptions; Act 250 Tier 1A; Act 250 Tier 1B; stormwater permits
10 Statement of purpose of bill as introduced: This bill proposes to allow
11 municipalities with permanent zoning and subdivision bylaws and an approved
12 town plan to designate Tier 1A and Tier 1B areas in the municipality and have
13 those areas be exempt from the requirements of 10 V.S.A. chapter 151 until
14 December 31, 2029. The bill would also require the Agency of Natural
15 Resources to transition the stormwater permitting process to a delegated
16 process where professional engineers are certified by the State to perform
17 stormwater assessments and designs and permit their own work. The State
18 would review the certified engineer’s work periodically and may revoke
19 certification if the work is not satisfactory.
