1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6Section 1. [16B.2971] ACQUISITION OF PROPERTY PROHIBITED; FLOOD
1.7CONTROL AND WATER RETENTION.
1.8(a) An agency or nonprofit organization may not acquire real property in fee or by
1.9easement for the purpose of a flood control or water retention project if the state owns land
1.10within the project area.
1.11(b) For the purposes of this section, a "flood control or water retention project" is a
1.12project with the primary purpose to hold water on the land or otherwise prevent flooding.
