A BILL TO BE ENTITLED
AN ACT
relating to the labeling of products as milk and milk products.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 435.001, Health and Safety Code, is
amended by adding Subdivisions (2-a) and (2-b) to read as follows:
(2-a) "Milk" means a liquid secreted by the mammary
glands of female mammals.
(2-b) "Milk product" means a product containing milk.
SECTION 2. Section 435.007, Health and Safety Code, is
amended by adding Subsection (d) to read as follows:
(d) A person may not represent, label, or advertise a
product as:
(1) milk if the product is not milk; or
(2) a milk product if the product is not a milk
product.
SECTION 3. This Act takes effect September 1, 2025.
