11 Statement of purpose of bill as introduced: This bill proposes to require a
12 written notice regarding the presence of perfluoroalkyl and polyfluoroalkyl
13 substances in firefighting station wear sold by a manufacturer or other person
14 in the State effective July 1, 2026. It further proposes to prohibit the sale and
15 distribution in the State of personal protective equipment and firefighting
16 station wear containing perfluoroalkyl and polyfluoroalkyl substances effective
17 July 1, 2028.

1 It is hereby enacted by the General Assembly of the State of Vermont:

3 Sec. 1. 9 V.S.A. § 2494p is amended to read:
4 § 2494p. DEFINITIONS
5    As used in this subchapter:

7(8) “Station wear” means uniform shirts and pants worn by firefighting
8 personnel in the performance of their duties, often underneath personal
9 protective equipment.
10 Sec. 2. 9 V.S.A. § 2494s is amended to read:
11 § 2494s. SALE OF PERSONAL PROTECTIVE EQUIPMENT AND
12STATION WEAR CONTAINING PFAS
13    (a) A manufacturer or other person that sells firefighting equipment to any
14 person, municipality, or State agency shall provide written notice to the
15 purchaser at the time of sale, citing to this subchapter, if the personal protective
16 equipment or station wear contains PFAS. The written notice shall include a
17 statement that the personal protective equipment or station wear contains
18 PFAS and the reason PFAS are added to the equipment.
19    (b) The manufacturer or person selling personal protective equipment or
20 station wear and the purchaser of the personal protective equipment or station

1 wear shall retain the notice for at least three years from the date of the
2 transaction.

4 Sec. 3. 9 V.S.A. § 2494s is amended to read:
5 § 2494s. PROHIBITED SALE OF PERSONAL PROTECTIVE
6EQUIPMENT AND STATION WEAR CONTAINING PFAS
7    (a) A manufacturer or other person that sells firefighting equipment to any
8 person, municipality, or State agency shall provide written notice to the
9 purchaser at the time of sale, citing to this subchapter, if the personal protective
10 equipment or station wear contains PFAS. The written notice shall include a
11 statement that the personal protective equipment or station wear contains
12 PFAS and the reason PFAS are added to the equipment not sell, offer for sale,
13 distribute for sale, or distribute for use in this State any personal protective
14 equipment or station wear to which PFAS have been intentionally added.
15    (b) The manufacturer or person selling personal protective equipment or
16 station wear and the purchaser of the personal protective equipment shall retain
17 the notice for at least three years from the date of the transaction. [Repealed.]

19 Sec. 4. EFFECTIVE DATES
20    (a) This section and Secs. 1 (definitions) and 2 (sale of personal protective
21 equipment and station wear containing PFAS) shall take effect on July 1, 2026.
