It further proposes to prohibit the sale and15 distribution in the State of personal protective equipment and firefighting16 station wear containing perfluoroalkyl and polyfluoroalkyl substances effective17 July 1, 2028.18 An act relating to perfluoroalkyl and polyfluoroalkyl substances in19 firefighting personal protective equipment and station wearVT LEG #380556 v.1BILL AS INTRODUCED H.2502025 Page 2 of 41 It is hereby enacted by the General Assembly of the State of Vermont:2* * * Effective July 1, 2026 * * *3 Sec. 1. 9 V.S.A. § 2494p is amended to read:4 § 2494p. DEFINITIONS5 As used in this subchapter:6***7(8) “Station wear” means uniform shirts and pants worn by firefighting8 personnel in the performance of their duties, often underneath personal9 protective equipment.10 Sec. 2. 9 V.S.A. § 2494s is amended to read:11 § 2494s. SALE OF PERSONAL PROTECTIVE EQUIPMENT AND12STATION WEAR CONTAINING PFAS13 (a) A manufacturer or other person that sells firefighting equipment to any14 person, municipality, or State agency shall provide written notice to the15 purchaser at the time of sale, citing to this subchapter, if the personal protective16 equipment or station wear contains PFAS. The written notice shall include a17 statement that the personal protective equipment or station wear contains18 PFAS and the reason PFAS are added to the equipment.19 (b) The manufacturer or person selling personal protective equipment or20 station wear and the purchaser of the personal protective equipment or stationVT LEG #380556 v.1BILL AS INTRODUCED H.2502025 Page 3 of 41 wear shall retain the notice for at least three years from the date of the2 transaction.3* * * Effective July 1, 2028 * * *4 Sec. 3. 9 V.S.A. § 2494s is amended to read:5 § 2494s. PROHIBITED SALE OF PERSONAL PROTECTIVE6EQUIPMENT AND STATION WEAR CONTAINING PFAS7 (a) A manufacturer or other person that sells firefighting equipment to any8 person, municipality, or State agency shall provide written notice to the9 purchaser at the time of sale, citing to this subchapter, if the personal protective10 equipment or station wear contains PFAS. The written notice shall include a11 statement that the personal protective equipment or station wear contains12 PFAS and the reason PFAS are added to the equipment not sell, offer for sale,13 distribute for sale, or distribute for use in this State any personal protective14 equipment or station wear to which PFAS have been intentionally added.15 (b) The manufacturer or person selling personal protective equipment or16 station wear and the purchaser of the personal protective equipment shall retain17 the notice for at least three years from the date of the transaction.
