1.1A bill for an act
1.2relating to education; allowing school districts to donate surplus schoolbooks;
1.3amending Minnesota Statutes 2024, section 123B.52, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5Section 1. Minnesota Statutes 2024, section 123B.52, is amended by adding a subdivision
1.6to read:
1.7Subd. 6a. Disposing of surplus books. Notwithstanding section 471.345, governing
1.8school district contracts made upon sealed bid or otherwise complying with the requirements
1.9for competitive bidding, other provisions of this section governing school district contracts,
1.10or other law to the contrary, a school district under this subdivision may dispose of
1.11schoolbooks, including library books, books from an individual classroom library, and
1.12textbooks including other materials accompanying a textbook. A school district may dispose
1.13of surplus books by donating them to a charitable organization under section 501(c)(3) of
1.14the Internal Revenue Code that is registered with the attorney general's office for educational
1.15use.
