A bill for an act
relating to education; allowing school districts to donate surplus schoolbooks;
amending Minnesota Statutes 2024, section 123B.52, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. Minnesota Statutes 2024, section 123B.52, is amended by adding a subdivision
to read:
Subd. 6a. Disposing of surplus books. Notwithstanding section 471.345, governing
school district contracts made upon sealed bid or otherwise complying with the requirements
for competitive bidding, other provisions of this section governing school district contracts,
or other law to the contrary, a school district under this subdivision may dispose of
schoolbooks, including library books, books from an individual classroom library, and
textbooks including other materials accompanying a textbook. A school district may dispose
of surplus books by donating them to a charitable organization under section 501(c)(3) of
the Internal Revenue Code that is registered with the attorney general's office for educational
use.
