1A BILL TO BE ENTITLED
2 AN ACT TO ALLOW CERTAIN EDUCATIONAL ORGANIZATIONS AND STATE
3     AGENCIES TO EXPEDITE THE PROCESS TO OBTAIN SURPLUS AND
4     DECOMMISSIONED FEDERAL MATERIAL AND PROPERTY.
5 The General Assembly of North Carolina enacts:
6SECTION 1. Part 2 of Article 3A of Chapter 143 of the General Statutes is amended
7 by adding the following new sections to read:
8 "§ 143-64.5A. Certain educational institutions exempt.
9     Notwithstanding any provisions or limitations of this Part, an educational organization is
10 authorized and empowered to obtain decommissioned and surplus material and property under
11 contracts and agreements with the federal government or any of its departments or agencies
12 provided that the material and property is intended to be used for educational purposes. For the
13 purposes of this section, the term "educational organization" means an organization that has
14 education as its primary purpose and that is a nonprofit organization, a not-for-profit
15 organization, or an organization that has tax-exempt status under 26 U.S.C. § 501(c)(3).
16 "§ 143-64.5B. Public safety exemption.
17     Notwithstanding any provisions or limitations of this Part, any State agency is authorized and
18 empowered to obtain decommissioned and surplus material and property under contracts and
19 agreements with the federal government or any of its departments or agencies provided that the
20 material and property is intended to promote public safety. For the purposes of this section, the
21 term "State agency" means any board, bureau, commission, department, institution, or agency of
22 the State."
23SECTION 2. This act is effective when it becomes law.
