[SEC5/14/2026 10:46 AM]Read the first time May 6, 2026________A billTO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION44-53-150 SO AS TO AUTHORIZE THE OVER-THE-COUNTER SALE OF IVERMECTIN TABLETS.Amend Title To ConformBe it enacted by theGeneral Assembly of the State of South Carolina:SECTION 1. Article 3, Chapter 53, Title 44 of the S.C. Code isamended by adding:Section44-53-150. (A) Notwithstanding anyprovision of law to the contrary, FDA-approved ivermectin product labeled forhuman use may be made available to the public for over-the-counter purchase inthis State to any person who is at least eighteen years of age, providedivermectin dispensed pursuant to this section must be maintained in an areaaccessible only to pharmacy personnel. No prescription order shall be requiredfor such purchase.(B)The Board of Pharmacy shall adopt rules to establish standard procedures forthe dispensing of ivermectin including the following:(1)providing the patient with a screening risk assessment tool;(2)providing the patient with information on the indications and contraindicationsfor the use of ivermectin, the appropriate method for using ivermectin, theimportance of medical follow-up, and any other information consideredappropriate by the department; and(3)prohibitions on dispensing ivermectin when contraindications or clinicallysignificant drug interactions exist based on a patient's medication profile ormedical conditions.(C)The Board of Pharmacy shall not require documentation beyond that reasonablynecessary to demonstrate compliance with this section and shall adopt rulesnecessary to implement this section within ninety days of the effective date.(D) Apharmacist may rely upon information provided by or on behalf of the patientwhen acting pursuant to this section and is not liable for incomplete,inaccurate, or omitted information provided by or on behalf of a patient. Apharmacist acting in good faith and with reasonable care pursuant to thissection is immune from disciplinary or adverse administrative actions from theBoard of Pharmacy and is immune from civil liability in the absence of grossnegligence or wilful misconduct. A pharmacist shall be deemed to have actedwith reasonable care when acting in accordance with rules or procedures adoptedby the Board of Pharmacy pursuant to this section.(E) Nothingin this section requires a pharmacist to:(1)dispense ivermectin, when in the pharmacist's professional judgment, dispensingmay jeopardize the health or safety of the patient; or(2)stock ivermectin.(F)Nothing in this section shall be construed to require a health insurance issuerto provide coverage for the cost of ivermectin dispensed pursuant to theprovisions of this section or to prevent a pharmacist from charging anadministrative or dispensing fee for the services provided pursuant to thissection.SECTION 2.
