1    Emergency preamble. Whereas, acts and resolves of the Legislature do not
2 become effective until 90 days after adjournment unless enacted as emergencies; and
3     Whereas, this legislation funds the maintenance, preservation and promotion of state
4 historic sites; and
5      Whereas, this legislation must take effect before the end of the current fiscal year so
6 that essential repairs and preservation efforts may begin as soon as possible; and
7     Whereas, in the judgment of the Legislature, these facts create an emergency within
8 the meaning of the Constitution of Maine and require the following legislation as
9 immediately necessary for the preservation of the public peace, health and safety; now,
10 therefore,
11 Be it enacted by the People of the State of Maine as follows:
12    Sec. 1. Fiscal year 2024-25 year-end unappropriated surplus; next priority
13 transfer. Notwithstanding any provision of law to the contrary, at the close of the fiscal
14 year ending June 30, 2025, as the next priority after the transfers authorized pursuant to the
15 Maine Revised Statutes, Title 5, sections 1507 and 1511, the transfer of $2,500,000 for the
16 Reserve for General Fund Operating Capital pursuant to Title 5, section 1536 and the
17 transfers to the Retiree Health Insurance Internal Service Fund pursuant to Title 5, section
18 1519 and after all required deductions of appropriations, budgeted financial commitments
19 and adjustments considered necessary by the State Controller have been made and after all
20 other transfers from the available balance of the unappropriated surplus of the General Fund
21 provided for in any other provision of law, the State Controller shall transfer from the
22 available balance of the unappropriated surplus of the General Fund up to $18,000,000 to
23 the Department of Agriculture, Conservation and Forestry, Parks - General Operations
24 program, Other Special Revenue Funds account to be used for the ongoing maintenance,
25 preservation and promotion of historic sites.
26     Emergency clause. In view of the emergency cited in the preamble, this legislation
27 takes effect when approved.
28SUMMARY
29     This bill requires the State Controller, as the next priority transfer at the close of fiscal
30 year 2024-25, after all transfers are made pursuant to statute and any other provision of
31 law, to transfer from the available balance of the unappropriated surplus of the General
32 Fund up to $18,000,000 to the Department of Agriculture, Conservation and Forestry,
33 Parks - General Operations program, Other Special Revenue Funds account to be used for
34 the ongoing maintenance, preservation and promotion of historic sites.
