This bill also proposes that the payroll records be subject to16 public inspection and copying under the Vermont Public Records Act.17 An act relating to payroll records of workers on State construction projects18 It is hereby enacted by the General Assembly of the State of Vermont:19 Sec. 1. 29 V.S.A. § 161 is amended to read:20 § 161. REQUIREMENTS ON STATE CONSTRUCTION PROJECTSVT LEG #380274 v.1BILL AS INTRODUCED H.3352025 Page 2 of 31***2 (d) Subsections (a) through (c) and subsection (g) of this section shall not3 apply to maintenance or construction projects carried out by the Agency of4 Transportation and by the Department of Forests, Parks and Recreation.5***6 (g) Employers and subcontractors contracting with the State of Vermont7 pursuant to this section shall keep a true and accurate record of all employees8 working on the project.9(1) For each employee, the record shall include:10(A) the name of the employee;11(B) the address of the employee;12(C) the hours worked by the employee;13(D) the wages paid to the employee;14(E) the employee’s rate of pay; and15(F) the classification of the employee; the licensed trades shall supply16 proof of classification of journey workers and indentured apprentices.17(2) The records described in subdivision (1) of this subsection shall be18 submitted weekly by U.S. mail or electronic mail to the State agency19 overseeing the construction project. The records shall be accompanied by a20 signed statement from the employer or subcontractor verifying the accuracy of21 the records.VT LEG #380274 v.1BILL AS INTRODUCED H.3352025 Page 3 of 31(3) Each employer and subcontractor shall preserve the records2 described in subdivision (1) of this section for three years from the date of3 completion of the State project. The records shall be available for inspection4 by the Commissioner of Labor or the Attorney General at any reasonable time5 upon request.6(4) The records received pursuant to subdivision (2) of this section shall7 be subject to inspection or copying pursuant to 1 V.S.A. §§ 315–320.8 Sec. 2.
