To amend title XVIII of the Social Security Act to prohibit hospitals from taking into account vaccination status in selecting organ recipients.
1.
Short title
This Act may be cited as the   Guaranteeing Individual Fairness in Transplants Act of 2025   or the   GIFT Act of 2025  .
2.
Prohibiting hospitals from taking into account vaccination status in selecting organ recipients
Section 1866(a)(1) of the Social Security Act ( 42 U.S.C. 1395cc(a)(1) ) is amended—
(1)
in subparagraph (X), by striking  and  at the end;
(2)
in subparagraph (Y), by striking the period at the end and inserting  , and ; and
(3)
by inserting after subparagraph (Y) the following new subparagraph:
(Z)
in the case of a hospital, critical access hospital, or rural emergency hospital, to not take into account the vaccination status of an individual when determining which individual should receive an organ transplant.
