s105/introduced.txtBILL AS INTRODUCED S.1052025 Page 1 of 41S.1052 Introduced by Senators Douglass, Baruth, Beck, Brock, Collamore,3Cummings, Gulick, Hart, Heffernan, Lyons, Major, Mattos and4Williams5 Referred to Committee on6 Date:7 Subject: Motor vehicles; operation of vehicles; inspections; new motor8vehicles; trailers9 Statement of purpose of bill as introduced: This bill proposes to provide that10 motor vehicles weighing 5,000 pounds or less that are less than two years old11 are exempt from inspections and to exempt all trailers and semi-trailers from12 inspections.13 An act relating to exemptions from vehicle inspections14 It is hereby enacted by the General Assembly of the State of Vermont:15 Sec. 1. 23 V.S.A. § 1222 is amended to read:16 § 1222. INSPECTION OF REGISTERED VEHICLES17 (a)(1) Except as otherwise provided in subdivision (3) of this subsection18 and for school buses, which shall be inspected as prescribed in section 1282 of19 this title, and motor buses as defined in subdivision 4(17) of this title, which20 shall be inspected twice during the calendar year at six-month intervals, allVT LEG #381115 v.1BILL AS INTRODUCED S.1052025 Page 2 of 41 motor vehicles registered in this State shall undergo a safety and visual2 emissions inspection once each year and all motor vehicles that are registered3 in this State and are 16 model years old or less shall undergo an emissions or4 on board diagnostic (OBD) systems inspection once each year as applicable.5 Any6(2) Except as otherwise provided in subdivision (3) of this subsection,7 any motor vehicle, trailer, or semi-trailer not currently inspected in this State8 shall be inspected within 15 days following the date of its registration in the9 State of Vermont.10(3)(A) Notwithstanding subdivisions (1) and (2) of this subsection (a), a11 motor vehicle that has a gross vehicle weight rating of not more than 5,00012 pounds shall not be required to be inspected pursuant to the provisions of this13 section until after 24 months have elapsed since the date of the vehicle’s14 manufacture.15(B) All trailers and semi-trailers shall be exempt from inspection16 pursuant to the provisions of this section.17***18 (d) Notwithstanding the provisions of subsection (a) of this section, an19 exhibition vehicle of model year 1940 or before registered as prescribed in20 section 373 of this title or a trailer registered as prescribed in subdivision21 371(a)(1)(A) of this title shall be exempt from inspection; provided, however,VT LEG #381115 v.1BILL AS INTRODUCED S.1052025 Page 3 of 41 the vehicle must be equipped as originally manufactured, must be in good2 mechanical condition, and must meet the applicable standards of the inspection3 manual.4***5 Sec. 2. 23 V.S.A. § 1223 is amended to read:6 § 1223. PROHIBITIONS7 A person shall not affix or cause to be affixed to a motor vehicle, trailer, or8 semi-trailer a certification of inspection that was not assigned by an official9 inspection station to such motor vehicle, trailer, or semi-trailer. No person10 shall reaffix or cause to be reaffixed an official sticker once removed; instead,11 replacement stickers shall be affixed as prescribed by the rules for replacement12 sticker agents. A person shall not knowingly operate a motor vehicle, trailer,13 or semi-trailer to which a certification of inspection is affixed if the14 certification of inspection was not assigned by an official station to that15 vehicle, trailer, or semi-trailer.16 Sec. 3. 23 V.S.A. § 4(61) is amended to read:17(61) “Storage trailer” means any regularly manufactured box type trailer18 that has been removed from normal over-the-highway service and is used19 solely for the storage of commodities at a fixed site for extended periods of20 time. When a storage trailer is moved over the public highways, it shall not21 contain cargo weighing more than 2,000 pounds and shall be properlyVT LEG #381115 v.1BILL AS INTRODUCED S.1052025 Page 4 of 41 equipped, and in good mechanical condition, and inspectable under the2 provisions of section 1222 of this title, except that storage trailers need not3 display an inspection sticker.4 Sec. 4.
