1A BILL TO BE ENTITLED
2 AN ACT PROVIDING THAT COUNTIES AND CITIES SHALL REQUIRE BENEFIT
3     PROVIDERS TO SUBMIT AN ANNUAL COMPENSATION DISCLOSURE.
4 The General Assembly of North Carolina enacts:
5SECTION 1. Article 23 of Chapter 153A of the General Statutes is amended by
6 adding a new section to read:
7 "§ 153A-466. Compensation paid to benefit providers.
8     Each provider of life, health, or other insurance, or other fringe benefits, including voluntary
9 benefits, to county employees, dependents of county employees, or persons retired from county
10 employment shall, on an annual basis, submit to the county a full compensation disclosure of all
11 funds paid to the provider by the county. For purposes of this section, the term "provider"
12 includes, but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy
13 benefits manager, and insurance company. The compensation disclosure shall include all of the
14 following:
15(1)     All income paid, directly or indirectly, to the provider, including, but not
16limited to, commissions, bonuses, fees, including fees for consulting or
17administrative services, and management compensation for shared risk
18arrangements in which the county participated for life, health, and other fringe
19benefits, including voluntary benefits.
20(2)     An affirmation that none of the compensation paid by the county has been
21provided to any county employee or elected official, directly or indirectly."
22SECTION 2. Article 21 of Chapter 160A of the General Statutes is amended by
23 adding a new section to read:
24 "§ 160A-485.1. Compensation paid to benefit providers.
25     Each provider of life, health, or other insurance, or other fringe benefits, including voluntary
26 benefits, to city employees, dependents of city employees, or persons retired from city
27 employment shall, on an annual basis, submit to the city a full compensation disclosure of all
28 funds paid to the provider by the city. For purposes of this section, the term "provider" includes,
29 but is not limited to, an agent, broker, consultant, third-party administrator, pharmacy benefits
30 manager, and insurance company. The compensation disclosure shall include all of the following:
31(1)     All income paid, directly or indirectly, to the provider, including, but not
32limited to, commissions, bonuses, fees, including fees for consulting or
