RYAN -- read twice and ordered printed, and whenprinted to be committed to the Committee on HealthAN ACT to amend the social services law, in relation to expanding Medi-caid coverage to include pharmacological treatment for hyperhidrosisTHE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-BLY, DO ENACT AS FOLLOWS:Section 1. Subdivision 2 of section 365-a of the social services lawis amended by adding a new paragraph (oo) to read as follows:(OO) PHARMACOLOGICAL TREATMENT FOR HYPERHIDROSIS, WHEN SUCH TREATMENTIS ORDERED BY A PHYSICIAN, REGISTERED PHYSICIAN ASSISTANT, OR REGISTEREDNURSE PRACTITIONER; PROVIDED, HOWEVER, THAT THE PROVISIONS OF THIS PARA-GRAPH SHALL NOT TAKE EFFECT UNLESS ALL NECESSARY APPROVALS UNDER FEDERALLAW AND REGULATION HAVE BEEN OBTAINED TO RECEIVE FEDERAL FINANCIALPARTICIPATION IN THE COSTS OF HEALTH CARE SERVICES PROVIDED PURSUANT TOTHIS PARAGRAPH. NOTHING IN THIS PARAGRAPH SHALL BE CONSTRUED TO MODIFYANY LICENSURE, CERTIFICATION OR SCOPE OF PRACTICE PROVISION UNDER TITLEEIGHT OF THE EDUCATION LAW.§ 2. This act shall take effect on the one hundred eightieth day afterit shall have become a law. Effective immediately, the addition, amend-ment and/or repeal of any rule or regulation necessary for the implemen-tation of this act on its effective date are authorized to be made andcompleted on or before such effective date.EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets[ ] is old law to be omitted.LBD14125-01-5
Expands Medicaid coverage to include pharmacological treatment for hyperhidrosis when such treatment is ordered by a physician, registered physician assistant, or registered nurse practitioner; provides that the provisions shall not take effect unless all necessary approvals under federal law and regulation have been obtained to receive federal financial participation in the costs.
