ENROLLED HOUSE BILL No. 4358
AN ACT to amend 1909 PA 279,
entitled �An act to provide for the incorporation of cities and for revising
and amending their charters; to provide for certain powers and duties; to
provide for the levy and collection of taxes by cities, borrowing of money, and
issuance of bonds or other evidences of indebtedness; to validate actions
taken, bonds issued, and obligations heretofore incurred; to prescribe
penalties and provide remedies; and to repeal acts and parts of acts on
specific dates,� (MCL 117.1 to 117.38) by adding section 3c.
The People of the State of
Michigan enact:
Sec.
3c. (1) Except as otherwise provided in this section and notwithstanding any
charter provision to the contrary, all terms of city officers elected after
December 31, 2024 must not commence earlier than at 12 noon on the first day of
the month following the officer�s election. If a city�s charter provides for
terms of city officers to commence after an election and before the first day
of the month following the officer�s election, all terms of city officers
elected in that city after December 31, 2024 commence at 12 noon on the first
day of the month following the officer�s election.
(2) Notwithstanding any charter provision to the contrary, an
individual elected to fill a vacancy shall not take the oath of office until
the results have been certified by the appropriate board of canvassers.
This act is ordered to take
immediate effect.
