hb4362/engrossed.txtHOUSE BILL NO. 4362A bill to amend 2012 PA 176, entitled"Mozelle senior or vulnerable adult medical alertact,"by amending the title and section 5 (MCL 28.715).the people of the state of michigan enact:TITLEAn act to prescribe the senior or vulnerable adultmedical alert as the official response to reports of certain missing persons;to provide for the broadcast of information regarding those incidents; and to providefor certain civil immunity; andto provide for the powers and duties of certain state and local governmentalofficers and entities.Sec. 5. (1) After obtaining the information identified insection 3, the law enforcement agency shall as soon as practicable forward thatinformation to all of the following:(a) All lawenforcement agencies that have jurisdiction in the location where the missingsenior or vulnerable adult resides and all law enforcement agencies that havejurisdiction in the location where the missing senior or vulnerable adult waslast seen.(b) All lawenforcement agencies to which the person who made the notification concerningthe missing senior or vulnerable adult requests the report be sent, if the lawenforcement agency determines that the request is reasonable in light of theinformation received.(c) All lawenforcement agencies that request a copy of the report.(d) One or morebroadcasters that broadcast in an area where the missing senior or vulnerableadult may be located.(2) Upon the completion of the report required by under section3, a law enforcement agency may forward a copy of the contents of the report to1 or more newspapers distributed in an area where the missing senior orvulnerable adult may be located.(3) Afterforwarding the contents of the report to a broadcaster or newspaper under thissection, the law enforcement agency shall request that the broadcaster ornewspaper do both of the following:(a) Notify thepublic that there is a missing senior or vulnerable adult medical alert.(b) Broadcast orpublish a description of the missing senior or vulnerable adult and any otherrelevant information that would assist in locating the missing senior orvulnerable adult.(4) Thedepartment of state police shall establish and maintain the missing senior orvulnerable adult medical alert system plan.(5) Themissing senior or vulnerable adult medical alert system plan must be designedto rapidly disseminate useful information in a predetermined manner to wirelessdevices through the existing wireless emergency medical alert system operatedunder federal law.(6) Themissing senior or vulnerable adult medical alert system plan may be activatedonly after a report is completed under section 3 and only in accordance withthe policies established by the department of state police.(7) Upon thecompletion of the report required under section 3, a law enforcement agencyshall notify the department of state police of the missing senior or vulnerableadult and request that a medical alert be issued under the missing senior orvulnerable adult medical alert system plan.
