R. 4316 IN THE HOUSE OF REPRESENTATIVES July 10, 2025 Mr. Carbajal (for himself and Mr. Cisneros ) introduced the following bill; which was referred to the Committee on Armed Services , and in addition to the Committee on the Judiciary , for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned A BILLTo amend title 10, United States Code, to authorize the enlistment of certain aliens in the Armed Forces, and for other purposes.1.Short titleThis Act may be cited as the Fight for the American Dream Act .2.Additional qualified persons for enlistment in the Armed Forces(a)In generalSection 504(b)(1) of title 10, United States Code, is amended by adding at the end the following:(D)A person who, at the time of enlistment in an armed force, possesses an employment authorization document issued by U.S. Citizenship and Immigration Services under the requirements of the Department of Homeland Security policy entitled Deferred Action for Childhood Arrivals ..(b)Clerical amendments(1)Section headingSection 504 of title 10, United States Code, is amended, in the section heading, by adding at the end the following:; citizenship or residency requirements; exceptions(2)Table of sectionsThe table of sections at the beginning of chapter 31 of title 10, United States Code, is amended by striking the item relating to section 504 and inserting the following:504. Persons not qualified; citizenship or residency requirements; exceptions..3.Military naturalization modernization(a)In generalChapter 2 of title III of the Immigration and Nationality Act ( 8 U.S.C. 1421 et seq. ) is amended—(1)by striking section 328 ( 8 U.S.C. 1439 ); and(2)in section 329 ( 8 U.S.C. 1440 )—(A)by amending the section heading to read as follows:Naturalization through service in the selected reserve or in active-duty status. ;(B)in subsection (a)—(i)in the matter preceding paragraph (1), by striking during either and all that follows through foreign force ;(ii)in paragraph (1)—(I)by striking America Samoa, or Swains Island and inserting American Samoa, Swains Island, or any of the freely associated States (as defined in section 611(b)(1)(C) of the Individuals with Disabilities Education Act ( 20 U.S.C. 1411(b)(1)(C) ), ; and(II)by striking he and inserting such person ; and(iii)in paragraph (2), by striking in an active-duty status, and whether separation from such service was under honorable conditions and inserting in accordance with subsection (b)(3) ; and(C)in subsection (b)—(i)in paragraph (1), by striking he and inserting such person ; and(ii)in paragraph (3), by striking in an active-duty status and all that follows through foreign force, and and inserting in an active status (as defined in section 101(d) of title 10, United States Code), in the Selected Reserve of the Ready Reserve, or on active duty (as defined in such section) and, if separated .(b)Clerical amendmentThe table of contents for the Immigration and Nationality Act ( 8 U.S.C. 1101 et seq. ) is amended by striking the items relating to sections 328 and 329 and inserting the following:Sec. 329.
