sb510/introduced.txtSENATE BILL NO. 510A bill to amend 1931 PA 328, entitled"The Michigan penal code,"(MCL 750.1 to 750.568) by adding section 396a.the people of the state of michigan enact:Sec. 396a. (1)Except as provided under subsection (2), a law enforcement officer, whileinteracting with a member of the public in the performance of the lawenforcement officer's duties, shall wear an appropriate uniform and shall notwear a mask or personal disguise.(2) A law enforcement officer may wear a mask in any of the followingcircumstances:(a) To prevent the law enforcement officer from contracting an airbornedisease, the law enforcement officer may wear a mask that is designed toprevent the transmission of airborne disease.(b) To protect the law enforcement officer from airborne toxins during astate of emergency, the law enforcement officer may wear a mask that protectsagainst exposure to the airborne toxins during the state of emergency.(c) The law enforcement officer may wear a mask that provides physicalprotection to the face.(3) A law enforcement officer who violates subsection (1) is guilty of amisdemeanor punishable by imprisonment for not more than 90 days or a fine ofnot more than $500.00.(4) This section does not apply to a law enforcement officer engaged inan undercover assignment.(5) As used in this section:(a) "Appropriate uniform" means a uniform that displays thelaw enforcement officer's name or badge number.(b) "Law enforcement officer" means all of the following:(i) A lawenforcement officer as that term is defined in section 2 of the Michigancommission on law enforcement standards act, 1965 PA 203, MCL 28.602.(ii) A federal lawenforcement officer.(c) "Mask" includes, but is not limited to, a piece ofnontransparent material meant to cover the face or conceal an individual'sidentity that would otherwise be readily apparent. Mask does not include a faceshield that does not conceal the wearer's face.(d) "Undercover assignment" means any investigative activity thatinvolves the use of an assumed name or cover identity by a law enforcementofficer under the jurisdiction of a federal law enforcement agency, local lawenforcement agency, or another law enforcement agency of this state.Enacting section 1.This amendatory act takes effect 90 days after the date it is enacted into law.
