2An act relating to Jefferson County; providing
3applicability; providing definitions; limiting
4compensation to a health care provider that provides
5medical services for an inmate housed in a Jefferson
6County detention center if the provider does not have
7a contract with the county to provide such services;
8limiting compensation to an entity that provides
9emergency medical transportation services for an
10inmate housed in a Jefferson County detention center
11if the entity does not have a contract with the county
12to provide such services; providing applicability;
13providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17Section 1.       (1) Notwithstanding any other law to the
18contrary, this act and all rules adopted pursuant to this act
19apply to the area located within Jefferson County.
20(2)     As used in this act, the term:
21(a)     "Emergency medical transportation services" includes,
22but is not limited to, services rendered by means of air
23ambulance or an emergency medical services vehicle. As used in
24this paragraph, the term:
251.      "Air ambulance" means a fixed-wing or rotary-wing

26    aircraft used for, or intended to be used for, air
27    transportation of sick or injured persons requiring or likely to
28    require medical attention during transport.
292.      "Emergency medical services vehicle" means a privately
30    or publicly owned vehicle or vessel that is designed,
31    constructed, reconstructed, maintained, equipped, or operated
32    for, and is used or intended to be used for, land or water
33    transportation of sick or injured persons requiring or likely to
34    require medical attention during transport.
35(b)      "Health care provider" means:
361.      A hospital licensed under chapter 395, Florida
37    Statutes.
382.      A physician or physician assistant licensed under
39    chapter 458, Florida Statutes.
403.      An osteopathic physician or physician assistant
41    licensed under chapter 459, Florida Statutes.
424.      A podiatric physician licensed under chapter 461,
43    Florida Statutes.
445.      A health maintenance organization certificated under
45    part I of chapter 641, Florida Statutes.
466.      An ambulatory surgical center licensed under chapter
47    395, Florida Statutes.
487.      An other medical facility. As used in this
49    subparagraph, the term "other medical facility" means a facility
50    the primary purpose of which is to provide human medical

51    diagnostic services or a facility providing nonsurgical human
52    medical treatment, to which facility the patient is admitted and
53    from which facility the patient is discharged within the same
54    working day, and which facility is not part of a hospital.
55    However, the term does not include a facility existing for the
56    primary purpose of performing terminations of pregnancy or an
57    office maintained by a physician or dentist for the practice of
58    medicine.
598.      A professional association, partnership, corporation,
60    joint venture, or other association composed of the persons
61    described in subparagraphs 2., 3., and 4. for professional
62    activity.
63(3)(a)      Except as provided in paragraph (b), compensation
64    to a health care provider to provide medical services for an
65    inmate housed in a Jefferson County detention center may not
66    exceed 110 percent of the Medicare allowable rate if the health
67    care provider does not have a contract with Jefferson County to
68    provide inmate medical services.
69(b)      Compensation to a health care provider to provide
70    medical services for an inmate housed in a Jefferson County
71    detention center may not exceed 125 percent of the Medicare
72    allowable rate if the health care provider:
731.      Does not have a contract with Jefferson County to
74    provide inmate medical services; and
752.      Reported a negative operating margin for the previous

76    year to the Agency for Health Care Administration through
77    hospital-audited financial data.
78(4)     Compensation to an entity to provide emergency medical
79    transportation services for an inmate housed in a Jefferson
80    County detention center may not exceed 110 percent of the
81    Medicare allowable rate if the entity does not have a contract
82    with Jefferson County to provide inmate emergency medical
83    transportation services.
84(5)     This act does not apply to charges for medical
85    services provided at a hospital operated by Jefferson County.
86Section 2.       This act shall take effect upon becoming a law.
