sb571/introduced.txtSENATE BILL NO. 571A bill to amend 1979 PA 152, entitled"State license fee act,"by amending section 5 (MCL 338.2205), as amended by2004 PA 263.the people of the state of michigan enact:Sec. 5. (1) Except under as otherwiseprovided by rules promulgated by the department pursuant to this section undersubsection (2) or as provided under section 411 of the occupationalcode, MCL 339.411, a fee collected by thedepartment, when paid pursuant to in accordance with this act, shall must not berefunded.(2) The departmentshall promulgate rules concerning the refund of fees , pursuant to under theadministrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.(3) At thebeginning of each state fiscal year, the department may promulgate rules under theadministrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328, toincrease the fees collected under this act by a percentage amount equal to notmore than the average percentage wage and salary increase granted for thatfiscal year to classified civil service employees who are employed by thedepartment.(4) If thedepartment increases fees under subsection (3), the increase is effective forthat fiscal year. The department shall use the increased fees as the basis forcalculating a fee increase in subsequent fiscal years.(5) ByAugust 1 of each year, the department shall provide the director of thedepartment of technology, management, and budget and the chairpersons of thesenate and house of representatives appropriations committees a completeschedule of fees to be collected under this act for the following fiscal year.
