SHORT TITLE.4This Act may be cited as the ‘‘Route 66 National5 Historic Trail Designation Act’’.6 SEC. 2. DESIGNATION OF ROUTE 66 NATIONAL HISTORIC7TRAIL.8Section 5(a) of the National Trails System Act (16kjohnson on DSK7ZCZBW3PROD with $$_JOB9 U.S.C. 1244(a)) is amended—VerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547021(1) by redesignating the second paragraph (31)2(relating to Butterfield Overland National Historic3Trail) as paragraph (32); and4(2) by adding at the end the following:5‘‘(33) ROUTE 66 NATIONAL HISTORIC TRAIL.—6‘‘(A) IN GENERAL.—The Route 66 Na-7tional Historic Trail, a trail that includes all8the alignments of U.S. Highway 66 in existence9between 1926 and 1985, extending along a10route of approximately 2,400 miles from Chi-11cago, Illinois, to Santa Monica, California, as12generally depicted on the map entitled ‘Route1366 National Historic Trail, Proposed Route’,14numbered P26/141,279, and dated December152017.16‘‘(B) AVAILABILITY OF MAP.—The map17described in subparagraph (A) shall be on file18and available for public inspection in the appro-19priate offices of the National Park Service, De-20partment of the Interior.21‘‘(C) ADMINISTRATION.—22‘‘(i) IN GENERAL.—The Route 66 Na-23tional Historic Trail shall be administeredkjohnson on DSK7ZCZBW3PROD with $$_JOB24by the Secretary of the Interior, acting25through the Director of the National Park•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547031Service. Such administration shall be con-2ducted in a manner that respects and3maintains the idiosyncratic nature of the4Route 66 National Historic Trail.5‘‘(ii) TRIBAL CONSULTATION.—Con-6sistent with Executive Order 13175 (257U.S.C. 5301 note; relating to consultation8and coordination with Indian Tribal Gov-9ernments) and all other applicable Federal10law, the Secretary of the Interior shall con-11duct active, meaningful, and timely con-12sultation with all affected Indian Tribes13prior to undertaking an activity with re-14spect to the Route 66 National Historic15Trail that would have substantial direct16impacts on 1 or more Indian Tribes.17‘‘(D) LAND ACQUISITION.—The United18States may not acquire for the Route 66 Na-19tional Historic Trail any land or interest in20land—21‘‘(i) outside the exterior boundary of22any federally managed area without the23consent of the owner of the land or interestkjohnson on DSK7ZCZBW3PROD with $$_JOB24in land; or•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547041‘‘(ii) that extends more than an aver-2age of one-quarter of a mile on either side3of the trail.4‘‘(E) NO BUFFER ZONE CREATED.—Noth-5ing in this Act, the acquisition of the land or6an interest in land authorized by this Act, or7the management plan for the Route 66 Na-8tional Historic Trail shall be construed to cre-9ate buffer zones outside of the Trail. That ac-10tivities or uses can be seen, heard, or detected11from the acquired land shall not preclude, limit,12control, regulate, or determine the conduct or13management of activities or uses outside of the14trail.15‘‘(F) ENERGY.—Nothing in this Act, the16acquisition of land or an interest in land au-17thorized by this Act, or the management plan18for the Route 66 National Historic Trail shall19prohibit, hinder, or disrupt the current or fu-20ture development, production, transportation, or21transmission of energy, including the construc-22tion or maintenance of pipelines, renewable en-23ergy projects, or other infrastructure for the de-kjohnson on DSK7ZCZBW3PROD with $$_JOB24velopment, production, transportation, or trans-25mission of energy.•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547051‘‘(G) EMINENT DOMAIN OR CONDEMNA-2TION.—In carrying out this Act, the Secretary3of the Interior may not use eminent domain or4condemnation.5‘‘(H) NOT A DESIGNATION OF ‘LANDS IN6THE NATIONAL PARK SYSTEM’.—Notwith-7standing any other provision of law, the des-8ignation of the Route 66 National Historic9Trail by this paragraph shall not have the effect10of designating the Route 66 National Historic11Trail or any land on which the Route 66 Na-12tional Historic Trail is located as ‘lands in the13National Park System’ for purposes of section1428(b)(1) of the Mineral Leasing Act (30 U.S.C.15185(b)(1)).16‘‘(I) NO NEW AUTHORITIES OR PERMIT.—17‘‘(i) NO EFFECT ON AUTHORITY TO18GRANT EASEMENTS OR RIGHTS-OF-WAY.—19‘‘(I) IN GENERAL.—Notwith-20standing any other provision of law,21the designation of the Route 66 Na-22tional Historic Trail by this para-23graph shall not alter or affect the ex-kjohnson on DSK7ZCZBW3PROD with $$_JOB24isting authority of any Federal, State,25or local agency or official to grant•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547061easements or rights-of-way over,2under, across, or along any portion of3the area designated as the Route 664National Historic Trail.5‘‘(II) AUTHORITY OF HEADS OF6FEDERAL AGENCIES TO GRANTS EASE-7MENTS OR RIGHTS-OF-WAY.—Notwith-8standing the designation of the Route966 National Historic Trail by this10paragraph, the head of any Federal11agency having jurisdiction over any12Federal land on which the Route 6613National Historic Trail designated by14this paragraph is located (other than15land that is considered to be ‘lands in16the National Park System’ for pur-17poses of section 28(b)(1) of the Min-18eral Leasing Act (30 U.S.C.19185(b)(1)) as a result of a designation20under any other law), shall have the21authority to grant easements or22rights-of-way over, under, across, or23along any applicable portion of thekjohnson on DSK7ZCZBW3PROD with $$_JOB24Route 66 National Historic Trail in•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H5470.IH H547071accordance with the laws applicable to2the Federal land.3‘‘(ii) NO NEW PERMITS REQUIRED.—4Notwithstanding any other provision of5law, the designation of the Route 66 Na-6tional Historic Trail by this paragraph7shall not subject the Route 66 National8Historic Trail or any land on which the9Route 66 National Historic Trail is located10to any other Federal laws (including regu-11lations) requiring a Federal permit or au-12thorization that would otherwise be made13applicable as a result of the designation of14the Route 66 National Historic Trail as a15component of the National Trails Sys-16tem.’’.Ækjohnson on DSK7ZCZBW3PROD with $$_JOB•HR 5470 IHVerDate Sep 11 2014 23:18 Sep 29, 2025 Jkt 059200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6301 E:\BILLS\H5470.IH H5470
