1A bill to be entitled
2An act relating to protection from surgical smoke;
3creating s. 395.1013, F.S.; defining the terms "smoke
4evacuation system" and "surgical smoke"; requiring
5hospitals and ambulatory surgical centers to, by a
6specified date, adopt and implement policies requiring
7the use of smoke evacuation systems or any other
8appropriate measure under certain circumstances;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13Section 1.  Section 395.1013, Florida Statutes, is created
14to read:
15395.1013  Smoke evacuation systems required.—
16(1)     As used in this section, the term:
17(a)     "Smoke evacuation system" means equipment that
18effectively captures and filters surgical smoke before the smoke
19makes contact with the eyes or respiratory tracts of occupants
20in the room.
21(b)     "Surgical smoke" means the gaseous byproduct produced
22by energy-generating devices such as lasers and electrosurgical
23devices. The term includes, but is not limited to, surgical
24plume, smoke plume, bio-aerosols, laser-generated airborne
25contaminants, and lung-damaging dust.

26(2)     By January 1, 2027, each licensed facility shall adopt
27    and implement policies to prevent exposure to surgical smoke,
28    where there is a substantial likelihood of risk to patients and
29    personnel, by using a smoke evacuation system or any other
30    appropriate measure.
31Section 2.  This act shall take effect July 1, 2026.
