No. 2735Senate, November 19, 2025 -- Substituted as a new draft (Senator Dooner) for the Senate Billdissolving the North Carver water district (Senate, No. 2517).The Commonwealth of Massachusetts_______________In the One Hundred and Ninety-Fourth General Court(2025-2026)_______________An Act dissolving the North Carver water district.Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authorityof the same, as follows:1SECTION 1. Chapter 124 of the acts of 2008 is hereby repealed and, notwithstanding2 any general or special law to the contrary, the North Carver Water District is hereby dissolved.3SECTION 2. Notwithstanding any general or special law to the contrary, without further4 conveyance or other action, all the assets, liabilities, obligations and indebtedness and the powers5 and duties of the North Carver Water District including, but not limited to, those enumerated in6 chapter 124 of the acts of 2008, are hereby transferred to the town of Carver; provided, however,7 that real property transferred pursuant to this act shall continue to be used for water supply8 purposes. The town of Carver may: (i) supply the area formerly defined as the district service9 area with water for the extinguishment of fires and for domestic and other purposes; (ii) establish10 fountains and hydrants and relocate and discontinue the same; (iii) regulate the use of such water11 and fix and collect rates to be paid therefor; (iv) assess and raise taxes for the payment of such12 services and for defraying the necessary expenses of operating a public water supply, subject to1 of 213 all general or special laws relating to municipal water supply services unless otherwise provided14 in this act.15SECTION 3. All members of the North Carver Water District commission serving prior16 to the effective date of this act shall immediately transfer all files, records and materials17 including, but not limited to, legal and financial records and other materials belonging to the18 North Carver Water District to the select board of the town of Carver.19SECTION 4. The board of water commissioners of the North Carver Water District is20 hereby abolished and the tenure of any incumbent members of the board shall terminate. The21 powers, duties and responsibilities of the board of water commissioners shall pass to the select22 board of the town of Carver and the director of operations for the town of Carver, respectively,23 who shall exercise authority and operation of the water system in accordance with this act and all24 general and special laws relative thereto.25SECTION 6. This act shall take effect upon its passage.2 of 2
