Section 523.010, RSMo, is repealed and one newsection enacted in lieu thereof, to be known as section 523.010,to read as follows:523.010. 1. In case land, or other property, issought to be appropriated by any road, railroad, streetrailway, telephone, telegraph or any electrical corporationorganized for the manufacture or transmission of electriccurrent for light, heat or power, including theconstruction, when that is the case, of necessary dams andappurtenant canals, flumes, tunnels and tailraces andincluding the erection, when that is the case, of necessaryelectric steam powerhouses, hydroelectric powerhouses andelectric substations or any oil, pipeline or gas corporationengaged in the business of transporting or carrying oil,liquid fertilizer solutions, or gas by means of pipes orpipelines laid underneath the surface of the ground, orother corporation created under the laws of this state forpublic use, and such corporation and the owners cannot agreeupon the proper compensation to be paid, or in the case theowner is incapable of contracting, be unknown, or be anonresident of the state, such corporation may apply to thecircuit court of the county of this state where such land orany part thereof lies by petition setting forth the generaldirections in which it is desired to construct its road,1railroad, street railway, telephone, or telegraph line orelectric line, including, when that is the case, theconstruction and maintenance of necessary dams andappurtenant canals, tunnels, flumes and tailraces and, whenthat is the case, the appropriation of land submerged by theconstruction of such dam, and including the erection andmaintenance, when that is the case, of necessary electricsteam powerhouses, hydroelectric powerhouses and electricsubstations, or oil, pipeline, liquid fertilizer solutionpipeline, or gas line over or underneath the surface of suchlands, a description of the real estate, or other property,which the company seeks to acquire; the names of the ownersthereof, if known; or if unknown, a pertinent description ofthe property whose owners are unknown and praying theappointment of three disinterested residents of the county,as commissioners, or a jury, to assess the damages whichsuch owners may severally sustain in consequence of theestablishment, erection and maintenance of such road,railroad, street railway, telephone, telegraph line, orelectrical line including damages from the construction andmaintenance of necessary dams and the condemnation of landsubmerged thereby, and the construction and maintenance ofappurtenant canals, flumes, tunnels and tailraces and theerection and maintenance of necessary electric steampowerhouses, hydroelectric powerhouses and electricsubstations, or oil, pipeline, or gas line over orunderneath the surface of such lands; to which petition theowners of any or all as the plaintiff may elect of suchparcels as lie within the county or circuit may be madeparties defendant by names if the names are known, and bythe description of the unknown owners of the land thereindescribed if their names are unknown.22. If the proceedings seek to affect the lands ofpersons under conservatorship, the conservators must be madeparties defendant. If the present owner of any land to beaffected has less estate than a fee, the person having thenext vested estate in remainder may at the option of thepetitioners be made party defendant; but if suchremaindermen are not made parties, their interest shall notbe bound by the proceedings.3. It shall not be necessary to make any persons partydefendants in respect to their ownership unless they areeither in actual possession of the premises to be affectedclaiming title or having a title of the premises appearingof record upon the proper records of the county.4. Except as provided in subsection 5 of this section,nothing in this chapter shall be construed to give a publicutility, as defined in section 386.020, or a rural electriccooperative, as provided in chapter 394, the power tocondemn property which is currently used by another providerof public utility service, including a municipality or aspecial purpose district, when such property is used oruseful in providing utility services, if the public utilityor cooperative seeking to condemn such property, directly orindirectly, will use or proposes to use the property for thesame purpose, or a purpose substantially similar to thepurpose for which the property is being used by the providerof the public utility service.5. A public utility or a rural electric cooperativemay only condemn the property of another provider of publicutility service, even if the property is used or useful inproviding utility services by such provider, if thecondemnation is necessary for the public purpose ofacquiring a nonexclusive easement or right-of-way across theproperty of such provider and only if the acquisition will3not materially impair or interfere with the current use ofsuch property by the utility or cooperative and will notprevent or materially impair such provider of public utilityservice from any future expansion of its facilities on suchproperty.6. If a public utility or rural electric cooperativeseeks to condemn the property of another provider of publicutility service, and the conditions in subsection 4 of thissection do not apply, this section does not limit thecondemnation powers otherwise possessed by such publicutility or rural electric cooperative.7. Suits in inverse condemnation or involvingdangerous conditions of public property against a municipalcorporation established under Article VI, Section 30(a) ofthe Missouri Constitution shall be brought only in thecounty where such land or any part thereof lies.8. For purposes of this chapter, the authority for anelectrical corporation as defined in section 386.020, exceptfor an electrical corporation operating under a cooperativebusiness plan as described in section 393.110, to condemnproperty for purposes of constructing an electric plantsubject to a certificate of public convenience and necessityunder subsection 1 of section 393.170 shall not extend tothe construction of a merchant transmission line withFederal Energy Regulatory Commission negotiated rateauthority unless such line has a substation or converterstation located in Missouri which is capable of deliveringan amount of its electrical capacity to electrical customersin this state that is greater than or equal to theproportionate number of miles of the line that passesthrough the state. The provisions of this subsection shallnot apply to applications filed pursuant to section 393.170prior to August 28, 2022.49. For the purposes of this chapter, the authority ofany corporation set forth in subsection 1 of this section tocondemn property shall not extend to:(1) The construction or erection of any plant, tower,panel, or facility that utilizes, captures, or converts windor air currents to generate or manufacture electricity; or(2) The construction or erection of any plant, tower,panel, or facility that utilizes, captures, or converts thelight or heat generated by the sun to generate ormanufacture electricity.10. Subject to the provisions of subsection 8 of thissection, but notwithstanding the provisions of subsection 9of this section to the contrary, the authority of anycorporation set forth in subsection 1 of this section tocondemn property shall extend to acquisition of rightsneeded to construct, operate, and maintain collection lines,distribution lines, transmission lines, communicationslines, substations, switchyards, and other facilities neededto collect and deliver energy generated or manufactured bythe facilities described in subsection 9 of this section tothe distribution or transmission grid.5
