1A bill to be entitled
2An act relating to violations of injunctions for
3protection against domestic violence; amending s.
4741.31, F.S.; providing that a person commits a felony
5of the third degree if such person commits a violation
6of an injunction or foreign protection order against a
7victim after having been convicted of any assault,
8battery, or violation of an injunction or foreign
9protection order against the same victim; requiring a
10minimum term of imprisonment for such offense;
11providing applicability; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15Section 1.  Paragraph (c) of subsection (4) of section
16741.31, Florida Statutes, is amended to read:
17741.31       Violation of an injunction for protection against
18domestic violence.—
19(4)
20(c)     A person who has one two or more prior convictions for
21any assault, battery, or violation of an injunction or foreign
22protection order, and who subsequently commits a violation of
23any injunction or foreign protection order against the same
24victim, commits a felony of the third degree, punishable as
25provided in s. 775.082, s. 775.083 or s. 775.084. A person

26    convicted of violating this paragraph must be sentenced to a
27    minimum of 10 days in the county jail for each violation, unless
28    the court sentences the person to a nonsuspended period of
29    incarceration in a state correctional facility. For purposes of
30    this paragraph, the term "conviction" means a determination of
31    guilt which is the result of a plea or a trial, regardless of
32    whether adjudication is withheld or a plea of nolo contendere is
33    entered.
34Section 2.  This act shall take effect October 1, 2026.
