WintertonHouse Sponsor: Joseph Elison23 LONG TITLE4 Committee Note:5The Government Operations Interim Committee recommended this bill.6Legislative Vote: 9 voting for 0 voting against 8 absent7 General Description:8This bill addresses the recovery of a fee charged by a credit card company or a processing9 agent to process an electronic payment.10 Highlighted Provisions:11This bill:12▸ permits a state institution of higher education or a local education agency to pass on to a13 person making an electronic payment the fee charged by a credit card company or a14 processing agent for processing the electronic payment.15 Money Appropriated in this Bill:16None17 Other Special Clauses:18None19 Utah Code Sections Affected:20 ENACTS:2153B-7-901, Utah Code Annotated 19532253B-7-902, Utah Code Annotated 19532353G-7-228, Utah Code Annotated 195324S.B. 1725 Be it enacted by the Legislature of the state of Utah:26Section 1. Section 53B-7-901 is enacted to read:27Part 9. Transactions2853B-7-901 . Definitions.29 As used in this part, "electronic payment fee" means a fee to recover the cost of paying a30 charge, discount fee, or processing fee charged by a credit card company or processing agentS.B. 17 01-26 09:2931 to process an electronic payment.32Section 2. Section 53B-7-902 is enacted to read:3353B-7-902 . Recovery of electronic payment fee.34 An institution of higher education may collect an electronic payment fee on an35 electronic payment made by a person to the institution of higher education.36Section 3. Section 53G-7-228 is enacted to read:3753G-7-228 . Recovery of electronic payment fee.38 (1) As used in this section, "electronic payment fee" means a fee to recover the cost of39 paying a charge, discount fee, or processing fee charged by a credit card company or40 processing agent to process an electronic payment.41 (2) An LEA may collect an electronic payment fee on an electronic payment made by a42 person to the LEA.43Section 4. Effective Date.44 This bill takes effect on May 6, 2026.-2-
