8This bill addresses the recovery of a fee charged by a credit card company or a processing
9   agent to process an electronic payment.

13   person making an electronic payment the fee charged by a credit card company or a
14   processing agent for processing the electronic payment.

25   Be it enacted by the Legislature of the state of Utah:
26Section 1. Section 53B-7-901 is enacted to read:

2853B-7-901 . Definitions.
29      As used in this part, "electronic payment fee" means a fee to recover the cost of paying a
30   charge, discount fee, or processing fee charged by a credit card company or processing agent

31  to process an electronic payment.
32Section 2. Section 53B-7-902 is enacted to read:
3353B-7-902 . Recovery of electronic payment fee.
34     An institution of higher education may collect an electronic payment fee on an
35  electronic payment made by a person to the institution of higher education.
36Section 3. Section 53G-7-228 is enacted to read:
3753G-7-228 . Recovery of electronic payment fee.
38  (1) As used in this section, "electronic payment fee" means a fee to recover the cost of
39      paying a charge, discount fee, or processing fee charged by a credit card company or
40      processing agent to process an electronic payment.
41  (2) An LEA may collect an electronic payment fee on an electronic payment made by a
42      person to the LEA.
43Section 4. Effective Date.
44  This bill takes effect on May 6, 2026.
