The title of the act of November 24, 200412 (P.L.1270, No.153), referred to as the Pennsylvania Amber Alert13 System Law, is amended to read:14AN ACT15 Providing for the Pennsylvania Amber Alert System, the Missing16 Endangered Person Advisory System and the Pennsylvania Purple17 Alert System; authorizing and directing the Pennsylvania18 State Police to establish and maintain [the Pennsylvania19 Amber Alert System] Pennsylvania's alert systems; assessing20 costs; and providing for immunity and penalties.1 Section 2. Section 1 heading of the act is amended and the2 section is amended by adding a subsection to read:3 Section 1. Pennsylvania Amber Alert System [and], Missing4Endangered Person Advisory System (MEPAS) and5Pennsylvania Purple Alert System established.6 * * *7 (c) Pennsylvania Purple Alert System.--8(1) The Pennsylvania State Police shall establish and9 maintain the Pennsylvania Purple Alert System to assist in10 the recovery of a missing qualifying individual who is at11 special risk of harm or injury, through prompt notification12 to the general public, appropriate law enforcement13 authorities and other public agencies.14(2) For purposes of paragraph (1), the term "qualifying15 individual" means an individual with a diagnosed16 intellectual, developmental, cognitive or neurological17 condition, including autism spectrum disorder, Alzheimer's18 disease when the individual is under the age of 60, dementia19 when the individual is under the age of 60, a traumatic brain20 injury or similar impairments.21 Section 3. Section 5(b) of the act is amended to read:22 Section 5. Immunity.23 * * *24 (b) Good Samaritan immunity.--Any person who provides,25 obtains or attempts to provide or obtain assistance for a child26 who is the subject of a Pennsylvania Amber Alert System notice27 [or], a person who is the subject of a Missing Endangered Person28 Advisory or a person who is the subject of a Pennsylvania Purple29 Alert System notice shall be immune from civil liability for30 acts or omissions in providing or obtaining or attempting to20250HB2102PN2705 - 2 -1 provide or obtain assistance except for acts or omissions2 intended to cause harm and for which the law does not recognize3 justification or that constitute gross negligence or willful,4 wanton or reckless conduct.5 Section 4.
