Document has been reformatted to meet World Wide Web specifications.)A billTO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDINGSECTION 38-21-225, RELATING TO THE ANNUAL GROUP CAPITAL CALCULATION FILINGDEADLINE IN THE INSURANCE HOLDING COMPANY REGULATORY ACT, SO AS TO ESTABLISHTHE DEADLINE AS MAY FIRST.Be it enacted by theGeneral Assembly of the State of South Carolina:SECTION 1. Section 38-21-225(B) of the S.C. Code is amended toread:(B) Except as provided below, theultimate controlling person of every insurer subject to registration must fileconcurrently with the registration an annual group capital calculation asdirected by the lead state commissioner. The report must be completed inaccordance with NAIC Group Capital Calculation instructions, which may permitthe lead state commissioner to allow a controlling person that is not theultimate controlling person to file the group capital calculation. The reportmust be filed with the lead state commissioner of the insurance holding companysystem as determined by the director in accordance with the procedures withinthe Financial Analysis Handbook adopted by the NAIC beforeMay first. The following insurance holding company systems are exemptfrom filing the group capital calculation:(1)an insurance holding company system that has only one insurer within itsholding company structure, that only writes business in its domestic state, andassumes no business from any other insurer;(2)an insurance holding company system that is required to perform a group capitalcalculation specified by the United States Federal Reserve Board. The leadstate commissioner must request the calculation from the Federal Reserve Boardunder the terms of information-sharing agreements in effect. If the FederalReserve Board cannot share the calculation with the lead state commissioner,the insurance holding company system is not exempt from the group capitalcalculation filing;(3)an insurance holding company system whose non-U.S. group-wide supervisor islocated within a reciprocal jurisdiction as described in Section 38-9-200 thatrecognizes the U.S. state regulatory approach to group supervision and groupcapital;(4)an insurance holding company system:(a)that provides information to the lead state that meets the requirements foraccreditation under the NAIC financial standards and accreditation program,either directly or indirectly through the group-wide supervisor, who hasdetermined such information is satisfactory to allow the lead state to complywith the NAIC group supervision approach, as detailed in the NAIC FinancialAnalysis Handbook, and(b)whose non-U.S. group-wide supervisor that is not in a reciprocal jurisdictionrecognizes and accepts, as specified by the director in regulation, the GroupCapital Calculation as the worldwide group capital assessment for U.S.insurance groups who operate in that jurisdiction.(5)Notwithstanding the provisions of this subsection, a lead state commissionermust require the group capital calculation for U.S. operations of anynon-U.S.-based insurance holding company system where, after any necessaryconsultation with other supervisors or officials, it is deemed appropriate bythe lead state commissioner for prudential oversight and solvency monitoringpurposes or for ensuring the competitiveness of the insurance marketplace.(6)Notwithstanding the exemptions from filing the group capital calculation statedin this section, the lead state commissioner has the discretion to exempt theultimate controlling person from filing the annual group capital calculation orto accept a limited group capital filing or report in accordance with criteriaas specified by the director in regulation.(7)If the lead state commissioner determines that an insurance holding companysystem no longer meets one or more of the requirements for an exemption fromfiling the group capital calculation under this section, the insurance holdingcompany system must file the group capital calculation at the next annualfiling date unless given an extension by the lead state commissioner based onreasonable grounds shown.SECTION 2.
