To amend title 49, United States Code, to require manufacture, sale, or import of a minimum number of motor vehicles that met certain standards for drunk and impaired driving prevention, and for other purposes.
1.
Short title
This Act may be cited as the   Deployment of Required Impairment Prevention Vehicle Equipment to Honor the Abbas Family Legacy to Terminate Drunk Driving Act of 2025   or the   DRIVE to HALT Drunk Driving Act  .
2.
Drunk and impaired driving prevention
(a)
In general
 Chapter 301  of title 49, United States Code, is amended by inserting after  section 30129  the following:
30130.
Drunk and impaired driving prevention
(a)
In general
Not later than 180 days after the date of enactment of this section, a covered manufacturer shall not manufacture for sale, sell, offer for sale, introduce or deliver for introduction in interstate commerce, or import into the United States less than—
(1)
10,000 passenger motor vehicles per calendar year that meet the performance specifications of the DADSS Subsystem Performance Specification Document; and
(2)
10,000 passenger motor vehicles per calendar year that comply with section 3.5.1 through 3.5.4.4 of the European New Car Assessment Programme version 10.3 (published December 2023).
(b)
Revised or new standard
(1)
In general
Except as provided in paragraph (2), not later than 120 days after the European New Car Assessment Programme revises the standard described in subsection (a)(2) or a subsequent standard, such revised standards shall replace the standard described in subsection (a)(2).
(2)
Determination
The Secretary, after publishing a notice in the Federal Register and allowing for a period of public comment and review, may make a determination that the revised standard described in paragraph (1) does not meet the need for motor vehicle safety.
(3)
Effect
Should the Secretary make a determination that the revised standard described in paragraph (1) does not meet the need for motor vehicle safety pursuant to paragraph (2), the revised or new standards shall not replace the standard described in subsection (a)(2).
(c)
Definitions
In this section:
(1)
Covered manufacturer
The term  covered manufacturer  means a manufacturer that, in the second most recent calendar year, manufactured for sale, sold, offered for sale, introduced or delivered for introduction in interstate commerce, or imported into the United States more than 250,000 motor vehicles.
(2)
Passenger motor vehicle
The term  passenger motor vehicle  means a motor vehicle that is not a commercial motor vehicle (as defined in section 31101).
(d)
Sunset
The requirements of this section shall expire upon the effective date of the rule required under section 24220 of the Infrastructure Investment and Jobs Act ( 49 U.S.C. 30111  note).

(b)
Clerical amendment
The analysis for subchapter II of  chapter 301  of title 49, United States Code, is amended by inserting after the item relating to  section 30129  the following:
30130. Drunk and impaired driving prevention.

(c)
Civil penalties
Section 30165(a)(1) of title 49, United States Code, is amended, in the first sentence, by inserting  30130(a),  after  30127, .
(d)
Amendments to title 49, united states code
Section 30102(b)(1) of title 49, United States Code, is amended—
(1)
in subparagraph (G), by striking  and  at the end;
(2)
in subparagraph (H), by striking the period at the end and inserting  ; and ; and
(3)
by adding at the end the following:
(I)
 motor vehicle safety standard  means—
(i)
a minimum standard for motor vehicle or motor vehicle equipment performance; and
(ii)
a requirement described in section 30130(a).
