Thompson23 LONG TITLE4 General Description:5This bill modifies the composition of the Public Land Management Advisory Board.6 Highlighted Provisions:7This bill:8▸ adds as a member of the Public Land Management Advisory Board:9● the state historic preservation officer or the officer's designee; and10● the director of the School and Institutional Trust Lands Administration or the director's11 designee; and12▸ makes technical and conforming changes.13 Money Appropriated in this Bill:14None15 Other Special Clauses:16None17 Utah Code Sections Affected:18 AMENDS:1963L-9-104, as renumbered and amended by Laws of Utah 2017, Chapter 4512021 Be it enacted by the Legislature of the state of Utah:22Section 1. Section 63L-9-104 is amended to read:2363L-9-104 . Public Land Management Advisory Board.24 (1) There is created the Public Land Management Advisory Board.S.B. 5325 (2) The board consists of the following [11] 13 members:26(a) the lieutenant governor, or the lieutenant governor's designee;27(b) the state historic preservation officer, created in Section 9-8a-202, or the state28historic preservation officer's designee;29(c) the director of the School and Institutional Trust Lands Administration, created in30Section 53C-1-201, or the director's designee;S.B. 53 01-27 08:0231 [(b)] (d) one representative, appointed by the governor, who represents the interests of32oil, gas, and mining;33 [(c)] (e) one representative, appointed by the governor, who represents the interests of34agriculture;35 [(d)] (f) one representative, appointed by the governor, who represents the interests of36outdoor recreation;37 [(e)] (g) one representative, appointed by the governor, who represents the interests of38environmental groups;39 [(f)] (h) three representatives, appointed by the governor, who represent the interests of40county commissioners;41 [(g)] (i) one representative, appointed by the governor, who represents the interests of42rural transportation;43 [(h)] (j) one representative, appointed by the governor, who represents the interests of44wildlife management; and45 [(i)] (k) one representative, appointed by the governor, who represents the interests of46forest management.47 (3)(a) Members [shall be] are appointed for a term of four years.48 (b) Notwithstanding the requirements of Subsection (3)(a), the governor shall, at the49time of appointment or reappointment, adjust the length of terms of the members50described in Subsections [(2)(b)] (2)(d) through [(i)] (k) to ensure that the terms of51board members are staggered so that half of the appointed board is appointed every52two years.53 (4) A member may serve more than one term.54 (5) A member shall hold office until the expiration of the member's term and until the55 member's successor is appointed, but not more than 90 days after the expiration of the56 member's term.57 (6) When a vacancy occurs in the membership for any reason, the governor shall appoint a58 replacement[ shall be appointed] for the remainder of the unexpired term.59 (7) The board shall elect annually a chair and a vice chair from the board's members.60 (8)(a) The board shall meet at least quarterly.61 (b) Special meetings may be called by the chair upon:62(i) the chair's own initiative[, upon ] ;63(ii) the request of the director[, or upon] ; or64(iii) the request of at least three members of the board.-2-01-27 08:02 S.B. 5365(c) [Three days' notice shall be given to ] The chair shall notify each member of the board66at least three days before a meeting.67 (9) [Six] Seven members constitute a quorum at a meeting, and the action of a majority of68members present is the action of the board.69 (10) A member may not receive compensation or benefits for the member's service, but70may receive per diem and travel expenses in accordance with:71(a) Section 63A-3-106;72(b) Section 63A-3-107; and73(c) rules made by the Division of Finance pursuant to Sections 63A-3-106 and7463A-3-107.75Section 2. Effective Date.76 This bill takes effect on May 6, 2026.-3-
