Synopsis: Stay of certain eviction actions against veterans. Provides
that a court shall stay certain eviction actions for defendants who
qualify and have applied for housing assistance from the United States
Department of Veterans Affairs or the Indiana department of veterans'
affairs.

                   HOUSE BILL No. 1127
    A BILL FOR AN ACT to amend the Indiana Code concerning
 property.
     Be it enacted by the General Assembly of the State of Indiana:
1    SECTION 1. IC 32-31-10-7 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2026]: Sec. 7. (a) If the defendant in an eviction action
4 demonstrates to the court that the defendant qualifies for and has
5 applied to receive housing assistance from the United States
6 Department of Veterans Affairs or the Indiana department of
7 veterans' affairs, the court shall stay the eviction action until the
8 earlier of the following:
9      (1) Forty-five (45) days after the order staying the eviction
10      action is issued.
11      (2) The housing assistance application has been processed and
12      either the housing assistance has been received by the
13      defendant or the application has been otherwise denied.
14    (b) Upon expiration of the stay described in subsection (a), the
15 court shall:
16      (1) dismiss the case;
17      (2) grant an additional stay in accordance with subsection (a);

1     or
2     (3) authorize the plaintiff to take action to further prosecute
3     the case;
4 based upon the facts of the case.
