3   LONG TITLE
4   General Description:
5This bill concerns impermissible law enforcement quotas.
6   Highlighted Provisions:
7This bill:
8▸ defines terms;
9▸ requires the State Commission on Criminal and Juvenile Justice to collect reports of
10   alleged violations of the impermissible law enforcement quota prohibition and annually
11   report the data to the Law Enforcement and Criminal Justice Interim Committee;
12▸ prohibits a political subdivision or law enforcement agency from:
13●   requiring or directing a peace officer to meet an impermissible quota; or
14●   transferring, promoting, disciplining, or taking other actions against a peace officer for
15   reasons relating to an impermissible quota; and
16▸ makes technical and conforming changes.

26   Be it enacted by the Legislature of the state of Utah:
27Section 1. Section 63M-7-204 is amended to read:
2863M-7-204 . Duties of commission.
29   (1) The commission shall:
30(a) promote the commission's purposes as enumerated in Section 63M-7-201;

31      (b) promote the communication and coordination of all criminal and juvenile justice
32agencies;
33      (c) study, evaluate, and report on the status of crime in the state and on the effectiveness
34of criminal justice policies, procedures, and programs that are directed toward the
35reduction of crime in the state;
36      (d) study, evaluate, and report on programs initiated by state and local agencies to
37address reducing recidivism, including changes in penalties and sentencing
38guidelines intended to reduce recidivism, costs savings associated with the reduction
39in the number of inmates, and evaluation of expenses and resources needed to meet
40goals regarding the use of treatment as an alternative to incarceration, as resources
41allow;
42      (e) study, evaluate, and report on policies, procedures, and programs of other
43jurisdictions [which] that have effectively reduced crime;
44      (f) identify and promote the implementation of specific policies and programs the
45commission determines will significantly reduce crime in Utah;
46      (g) provide analysis and recommendations on all criminal and juvenile justice
47legislation, state budget, and facility requests, including program and fiscal impact on
48all components of the criminal and juvenile justice system;
49      (h) provide analysis, accountability, recommendations, and supervision for state and
50federal criminal justice grant money;
51      (i) provide public information on the criminal and juvenile justice system and give
52technical assistance to agencies or local units of government on methods to promote
53public awareness;
54      (j) promote research and program evaluation as an integral part of the criminal and
55juvenile justice system;
56      (k) provide a comprehensive criminal justice plan annually;
57      (l) review agency forecasts regarding future demands on the criminal and juvenile
58justice systems, including specific projections for secure bed space;
59      (m) promote the development of criminal and juvenile justice information systems that
60are consistent with common standards for data storage and are capable of
61appropriately sharing information with other criminal justice information systems by:
62(i) developing and maintaining common data standards for use by all state criminal
63justice agencies;
64(ii) annually performing audits of criminal history record information maintained by

65state criminal justice agencies to assess their accuracy, completeness, and
66adherence to standards;
67(iii) defining and developing state and local programs and projects associated with
68the improvement of information management for law enforcement and the
69administration of justice; and
70(iv) establishing general policies concerning criminal and juvenile justice information
71systems and making rules as necessary to carry out the duties under Subsection
72(1)(k) and this Subsection (1)(m);
73      (n) allocate and administer grants, from money made available, for approved education
74programs to help prevent the sexual exploitation of children;
75      (o) allocate and administer grants for law enforcement operations and programs related
76to reducing illegal drug activity and related criminal activity;
77      (p) request, receive, and evaluate data and recommendations collected and reported by:
78(i) agencies and contractors related to policies recommended by the commission
79regarding recidivism reduction, including the data described in Section 13-53-111
80and Subsection 26B-5-102(2)(jj); and
81(ii) state agencies under Section 67-28-102;
82      (q) establish and administer a performance incentive grant program that allocates funds
83appropriated by the Legislature to programs and practices implemented by counties
84that reduce recidivism and reduce the number of offenders per capita who are
85incarcerated;
86      (r) oversee or designate an entity to oversee the implementation of juvenile justice
87reforms;
88      (s) make rules and administer the juvenile holding room standards and juvenile jail
89standards to align with the Juvenile Justice and Delinquency Prevention Act
90requirements pursuant to [42 U.S.C. Sec. 5633] 34 U.S.C. Sec. 11133;
91      (t) allocate and administer grants, from money made available, for pilot qualifying
92education programs;
93      (u) request, receive, and evaluate the aggregate data collected from prosecutorial
94agencies and the Administrative Office of the Courts, in accordance with Sections
9563M-7-216, 63M-7-216.1, and 78A-2-109.5;
96      (v) report annually to the Law Enforcement and Criminal Justice Interim Committee on
97the progress made on each of the following goals of the Justice Reinvestment
98Initiative:

99(i) ensuring oversight and accountability;
100(ii) supporting local corrections systems;
101(iii) improving and expanding reentry and treatment services; and
102(iv) strengthening probation and parole supervision;
103      (w) compile a report of findings based on the data and recommendations provided under
104Section 13-53-111 that separates the data provided under Section 13-53-111 by each
105residential vocational or life skills program;
106      (x) publish the report described in Subsection (1)(w) on the commission's website and
107annually provide the report to the Judiciary Interim Committee, the Health and
108Human Services Interim Committee, the Law Enforcement and Criminal Justice
109Interim Committee, and the related appropriations subcommittees;
110      (y) receive, compile, and publish on the commission's website the data provided under:
111(i) Section 53-25-202;
112(ii) Section 53-25-301; and
113(iii) Section 53-25-401;
114      (z) review, research, advise, and make recommendations to the three branches of
115government regarding evidence-based sex offense management policies and
116practices, including supervision standards, treatment standards, and the sex offender
117registry;
118      (aa) receive and evaluate a referral from the Department of Public Safety received under
119Section 53-21-104.3 involving a denial of mental health resources to an eligible
120individual, including, if appropriate in the commission's discretion, deny the relevant
121entity from receiving any grant of state funds under Section 63M-7-218 for a
122specified period of time;[ and]
123      (bb) receive, compile, and annually submit a report to the Law Enforcement and
124Criminal Justice Interim Committee of alleged violations of the impermissible law
125enforcement quota prohibition under Subsection 77-7-27(4); and
126      [(bb)] (cc) accept public comment.
127  (2)(a) The commission may designate an entity to perform the duties described in this
128      part.
129      (b) If the commission designates an entity under Subsection (2)(a), the commission shall
130ensure that the membership of the designated entity includes representation from
131relevant stakeholder groups from the parts of the justice system implicated in the
132policy area.

133   (3) In fulfilling the commission's duties under Subsection (1), the commission may seek
134input and request assistance from groups with knowledge and expertise in criminal
135justice, including other boards and commissions affiliated or housed within the
136commission.
137Section 2. Section 77-7-27 is amended to read:
13877-7-27 . Quotas for arrest, citation prohibited.
139   (1) As used in this section:
140(a)(i) "Impermissible quota" means a requirement or minimum standard regarding the
141number or percentage of citations made by a law enforcement officer.
142(ii) "Impermissible quota" does not include targeted overtime shifts for which a law
143enforcement agency receives grant money or other reimbursement.
144(b) "Law enforcement agency" means an entity of the state, or a political subdivision of
145the state, that exists primarily to prevent and detect crime and enforce criminal laws,
146statutes, or ordinances.
147[(b) "Law enforcement quota" means any requirement or minimum standard regarding
148the number or percentage of citations or arrests made by a law enforcement officer.]
149   (2) A political subdivision or law enforcement agency employing a peace officer may not:
150(a) require or direct that a peace officer meet [a law enforcement] an impermissible quota[.] ;
151(b) evaluate, promote, compensate, reward, or discipline a peace officer on the basis of
152an impermissible quota; or
153(c) transfer a peace officer's employment assignment on the basis of an impermissible
154quota.
155   (3) Subsection (2) does not prohibit a political subdivision or law enforcement agency from
156including a peace officer's engagement with the community or enforcement activity,
157including a metric based on the peace officer's interactions with members of the
158community, as part of an overall determination of the peace officer's performance.
159   (4) A person may report an alleged violation of this section to the State Commission on
160Criminal and Juvenile Justice.
161Section 3. Effective Date.
162   This bill takes effect on May 6, 2026.
