Wilcox23 LONG TITLE4 General Description:5 This bill specifies that a physician does not engage in unprofessional conduct by6 participating or refusing to participate in the execution of a death sentence.7 Highlighted Provisions:8 This bill:9 ▸ specifies that a physician does not engage in unprofessional conduct by participating or10 refusing to participate in the execution of a death sentence.11 Money Appropriated in this Bill:12 None13 Other Special Clauses:14 None15 Utah Code Sections Affected:16 AMENDS:17 58-67-502, as last amended by Laws of Utah 2025, Chapter 39218 58-68-502, as last amended by Laws of Utah 2025, Chapter 3921920 Be it enacted by the Legislature of the state of Utah:21Section 1. Section 58-67-502 is amended to read:2258-67-502 . Unprofessional conduct.23 (1) "Unprofessional conduct" includes, in addition to the definition in Section 58-1-501:24 (a) using or employing the services of any individual to assist a licensee in any manner25not in accordance with the generally recognized practices, standards, or ethics of the26profession, state law, or division rule;27 (b) making a material misrepresentation regarding the qualifications for licensure under28Section 58-67-302.7 or 58-67-302.8;S.B. 80 Enrolled Copy29(c) violating the dispensing requirements of Chapter 17b, Part 8, Dispensing Medical30Practitioner and Dispensing Medical Practitioner Clinic Pharmacy, if applicable;31(d) violating the requirements of Title 26B, Chapter 4, Part 2, Cannabinoid Research and32Medical Cannabis;33(e) performing or inducing an abortion in violation of the requirements of Section3476-7-302 or Section 76-7a-201, regardless of whether the individual licensed under35this chapter is found guilty of a crime in connection with the violation;36(f) falsely making an entry in, or altering, a medical record with the intent to conceal:37(i) a wrongful or negligent act or omission of an individual licensed under this38chapter or an individual under the direction or control of an individual licensed39under this chapter; or40(ii) conduct described in Subsections (1)(a) through (e) or Subsection 58-1-501(1);41(g) performing, or causing to be performed, upon an individual who is less than 18 years42old:43(i) a primary sex characteristic surgical procedure; or44(ii) a secondary sex characteristic surgical procedure; or45(h) designating a child as do not resuscitate without parental consent.46 (2) "Unprofessional conduct" does not include:47(a) in compliance with Section 58-85-103:48(i) obtaining an investigational drug or investigational device;49(ii) administering the investigational drug to an eligible patient; or50(iii) treating an eligible patient with the investigational drug or investigational device; [51or]52(b) in accordance with Title 26B, Chapter 4, Part 2, Cannabinoid Research and Medical53Cannabis:54(i) when acting as a recommending medical provider, as that term is defined in55Section 26B-4-201, recommending the use of medical cannabis; or56(ii) when registered as a pharmacy medical provider, as that term is defined in57Section 26B-4-201, providing pharmacy medical provider services in a medical58cannabis pharmacy[.] ;59(c) refusing to participate in the execution of a death sentence authorized under Section6077-19-10; or61(d) participating in the execution of a death sentence authorized under Section 77-19-1062in accordance with state law and Department of Corrections protocol.-2-Enrolled Copy S.B. 8063 (3) Notwithstanding Subsection (2)(b), the division, in consultation with the board and in64 accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, shall65 define unprofessional conduct for a physician described in Subsection (2)(b).66Section 2. Section 58-68-502 is amended to read:6758-68-502 . Unprofessional conduct.68 (1) "Unprofessional conduct" includes, in addition to the definition in Section 58-1-501:69 (a) using or employing the services of any individual to assist a licensee in any manner70not in accordance with the generally recognized practices, standards, or ethics of the71profession, state law, or division rule;72 (b) violating the dispensing requirements of Chapter 17b, Part 8, Dispensing Medical73Practitioner and Dispensing Medical Practitioner Clinic Pharmacy, if applicable;74 (c) making a material misrepresentation regarding the qualifications for licensure under75Section 58-68-302.5;76 (d) violating the requirements of Title 26B, Chapter 4, Part 2, Cannabinoid Research and77Medical Cannabis;78 (e) performing or inducing an abortion in violation of the requirements of Section7976-7-302 or Section 76-7a-201, regardless of whether the individual licensed under80this chapter is found guilty of a crime in connection with the violation;81 (f) falsely making an entry in, or altering, a medical record with the intent to conceal:82(i) a wrongful or negligent act or omission of an individual licensed under this83chapter or an individual under the direction or control of an individual licensed84under this chapter; or85(ii) conduct described in Subsections (1)(a) through (e) or Subsection 58-1-501(1);86 (g) performing or causing to be performed, upon an individual who is less than 18 years87old:88(i) a primary sex characteristic surgical procedure; or89(ii) a secondary sex characteristic surgical procedure; or90 (h) designating a child as do not resuscitate without parental consent.91 (2) "Unprofessional conduct" does not include:92 (a) in compliance with Section 58-85-103:93(i) obtaining an investigational drug or investigational device;94(ii) administering the investigational drug to an eligible patient; or95(iii) treating an eligible patient with the investigational drug or investigational device; [96or]-3-S.B. 80 Enrolled Copy97(b) in accordance with Title 26B, Chapter 4, Part 2, Cannabinoid Research and Medical98Cannabis:99(i) when acting as a recommending medical provider, as that term is defined in100Section 26B-4-201, recommending the use of medical cannabis; or101(ii) when registered as a pharmacy medical provider, as that term is defined in102Section 26B-4-201, providing pharmacy medical provider services in a medical103cannabis pharmacy[.] ;104(c) refusing to participate in the execution of a death sentence authorized under Section10577-19-10; or106(d) participating in the execution of a death sentence authorized under Section 77-19-10107in accordance with state law and Department of Corrections protocol.108 (3) Notwithstanding Subsection (2)(b), the division, in consultation with the board and in109accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, shall110define unprofessional conduct for a physician described in Subsection (2)(b).111Section 3. Effective Date.112 This bill takes effect on May 6, 2026.-4-
