4Relating to driver licenses; to authorize the Alabama
5 State Law Enforcement Agency to issue digital driver licenses
6 and nondriver identification cards.
7 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8Section 1. (a)(1) Pursuant to the procedures for
9 issuance and renewal of driver licenses and nondriver
10 identification cards established in Chapter 6 of Title 32,
11 Code of Alabama 1975, the Alabama State Law Enforcement Agency
12 (ALEA), contingent upon the availability of funds, shall issue
13 a digital driver license or nondriver identification card and
14 may charge an additional fee of up to fifteen dollars ($15),
15 which may be displayed through an ALEA-approved mobile
16 electronic method.
17(2) The digital driver license or nondriver
18 identification card may be issued in addition to a physical
19 driver license or nondriver identification card.
20(b) The digital driver license or nondriver
21 identification card shall contain all information present on a
22 physical driver license or nondriver identification card,
23 including a bar code or other mechanism, as utilized to reveal
24 the information.
25(c) A licensee may produce a valid ALEA-approved
26 digital driver license in lieu of possessing a physical driver
27 license when operating a motor vehicle or vessel pursuant to
28 Section 32-6-9, Code of Alabama 1975.

29(d)(1) Upon demand of a judge of any court in this
30 state, a peace officer, a state trooper, or any other state or
31 local governmental entity, a licensee may produce an
32 ALEA-approved digital driver license or nondriver
33 identification card, and it shall be recognized as though it
34 were a physical driver license or nondriver identification
35 card.
36(2) A licensee may not produce an approved digital
37 driver license or nondriver identification card in place of a
38 physical driver license or nondriver identification card as a
39 valid form of voter photo identification pursuant to Section
40 17-9-30, Code of Alabama 1975.
41(e) If the licensee displays the digital driver license
42 or nondriver identification card through the ALEA-approved
43 mobile method, the individual is not implicitly consenting to
44 allow access to or to search other contents of the wireless
45 communication or electronic device other than provided for by
46 law.
47(f) ALEA shall apply reasonable industry standards of
48 security to protect the integrity of the digital driver
49 license or nondriver identification card and privacy of the
50 licensee.
51(g) ALEA may adopt rules to implement this section.
52(h) ALEA shall deposit monies collected from the
53 additional fee under subsection (a) into the Public Safety
54 Fund in the State Treasury.
55Section 2. This act shall become effective on October
56 1, 2026.
