4  General Description:
5      This bill amends provisions related to controlled substance scheduling.
6  Highlighted Provisions:
7      This bill:
8      ▸ allows for the automatic rescheduling of a pharmaceutical composition of a schedule I
9  controlled substance if the pharmaceutical composition is rescheduled under federal law.

18  Be it enacted by the Legislature of the state of Utah:
19Section 1. Section 58-37-4 is amended to read:
2058-37-4 . Schedules of controlled substances -- Schedules I through V -- Findings
21  required -- Specific substances included in schedules.
22  (1) There are established five schedules of controlled substances known as Schedules I, II,
23      III, IV, and V which consist of substances listed in this section.
24  (2) Schedules I, II, III, IV, and V consist of the following drugs or other substances by the
25      official name, common or usual name, chemical name, or brand name designated:
26      (a) Except as provided in Subsection (3), Schedule I:
27(i) Unless specifically excepted or unless listed in another schedule, any of the
28following opiates, including their isomers, esters, ethers, salts, and salts of

29isomers, esters, and ethers, when the existence of the isomers, esters, ethers, and

217(iv) Unless specifically excepted or unless listed in another schedule, any material

246(vii) Unless specifically excepted or unless listed in another schedule, any material,
247compound, mixture, or preparation which contains any quantity of gamma
248hydroxy butyrate (gamma hydrobutyric acid), including its salts, isomers, and
249salts of isomers.
250(b) Schedule II:
251(i) Unless specifically excepted or unless listed in another schedule, any of the
252following substances whether produced directly or indirectly by extraction from
253substances of vegetable origin, or independently by means of chemical synthesis,
254or by a combination of extraction and chemical synthesis:
255(A) Opium and opiate, and any salt, compound, derivative, or preparation of
256opium or opiate, excluding apomorphine, dextrorphan, nalbuphine, nalmefene,
257naloxone, and naltrexone, and their respective salts, but including:
258(I) Raw opium;
259(II) Opium extracts;
260(III) Opium fluid;
261(IV) Powdered opium;

263(VI) Tincture of opium;

283whether derived from the coca plant or synthetically produced, except the

329(D) Methylphenidate.
330(iv) Unless specifically excepted or unless listed in another schedule, any material,
331compound, mixture, or preparation which contains any quantity of the following
332substances having a depressant effect on the central nervous system, including its
333salts, isomers, and salts of isomers when the existence of the salts, isomers, and
334salts of isomers is possible within the specific chemical designation:

335(A) Amobarbital;
336(B) Glutethimide;
337(C) Pentobarbital;
338(D) Phencyclidine;

341(F) Secobarbital.
342(v)(A) Unless specifically excepted or unless listed in another schedule, any

347(vi) Nabilone, another name for nabilone: (±

350(vii) A drug product or preparation that contains any component of marijuana,
351including tetrahydrocannabinol, and is approved by the United States Food and
352Drug Administration and scheduled by the Drug Enforcement Administration in
353Schedule II of the federal Controlled Substances Act, Title II, P.L. 91-513.
354      (c) Schedule III:
355(i) Unless specifically excepted or unless listed in another schedule, any material,
356compound, mixture, or preparation which contains any quantity of the following
357substances having a stimulant effect on the central nervous system, including its
358salts, isomers whether optical, position, or geometric, and salts of the isomers
359when the existence of the salts, isomers, and salts of isomers is possible within the
360specific chemical designation:
361(A) Those compounds, mixtures, or preparations in dosage unit form containing
362any stimulant substances listed in Schedule II, which compounds, mixtures, or
363preparations were listed on August 25, 1971, as excepted compounds under
364Section 1308.32 of Title 21 of the Code of Federal Regulations, and any other
365drug of the quantitive composition shown in that list for those drugs or which
366is the same except that it contains a lesser quantity of controlled substances;
367(B) Benzphetamine;
368(C) Chlorphentermine;

369(D) Clortermine; and
370(E) Phendimetrazine.
371(ii) Unless specifically excepted or unless listed in another schedule, any material,
372compound, mixture, or preparation which contains any quantity of the following
373substances having a depressant effect on the central nervous system:
374(A) Any compound, mixture, or preparation containing amobarbital, secobarbital,
375pentobarbital, or any salt of any of them, and one or more other active
376medicinal ingredients which are not listed in any schedule;
377(B) Any suppository dosage form containing amobarbital, secobarbital, or
378pentobarbital, or any salt of any of these drugs which is approved by the United
379States Food and Drug Administration for marketing only as a suppository;
380(C) Any substance which contains any quantity of a derivative of barbituric acid
381or any salt of any of them;
382(D) Chlorhexadol;
383(E) Buprenorphine;
384(F) Any drug product containing gamma hydroxybutyric acid, including its salts,
385isomers, and salts of isomers, for which an application is approved under the
386federal Food, Drug, and Cosmetic Act, Section 505;
387(G) Ketamine, its salts, isomers, and salts of isomers, some other names for
388ketamine: ± -2-(2-chlorophenyl)-2-(methylamino)-cyclohexanone;
389(H) Lysergic acid;
390(I) Lysergic acid amide;
391(J) Methyprylon;
392(K) Sulfondiethylmethane;
393(L) Sulfonethylmethane;
394(M) Sulfonmethane; and
395(N) Tiletamine and zolazepam or any of their salts, some trade or other names for
396a tiletamine-zolazepam combination product: Telazol, some trade or other

401(iii) Dronabinol (synthetic) in sesame oil and encapsulated in a soft gelatin capsule in

407(v) Unless specifically excepted or unless listed in another schedule, any material,
408compound, mixture, or preparation containing limited quantities of any of the
409following narcotic drugs, or their salts calculated as the free anhydrous base or
410alkaloid:
411(A) Not more than 1.8 grams of codeine per 100 milliliters or not more than 90
412milligrams per dosage unit, with an equal or greater quantity of an isoquinoline
413alkaloid of opium;

428ingredients in recognized therapeutic amounts;
429(G) Not more than 500 milligrams of opium per 100 milliliters or per 100 grams,
430or not more than 25 milligrams per dosage unit, with one or more active,
431non-narcotic ingredients in recognized therapeutic amounts; and
432(H) Not more than 50 milligrams of morphine per 100 milliliters or per 100 grams
433with one or more active, non-narcotic ingredients in recognized therapeutic
434amounts.
435(vi) Unless specifically excepted or unless listed in another schedule, anabolic
436steroids including any of the following or any isomer, ester, salt, or derivative of

465(vii) Anabolic steroids expressly intended for administration through implants to

467Human Services for use, may not be classified as a controlled substance.
468(viii) A drug product or preparation that contains any component of marijuana,
469including tetrahydrocannabinol, and is approved by the United States Food and
470Drug Administration and scheduled by the Drug Enforcement Administration in

567      (e) Schedule V:

569quantities of narcotic drugs, or their salts calculated as the free anhydrous base or
570alkaloid, which includes one or more non-narcotic active medicinal ingredients in
571sufficient proportion to confer upon the compound, mixture, or preparation
572valuable medicinal qualities other than those possessed by the narcotic drug alone:

573(A) not more than 200 milligrams of codeine per 100 milliliters or per 100 grams;
574(B) not more than 100 milligrams of dihydrocodeine per 100 milliliters or per 100

576(C) not more than 100 milligrams of ethylmorphine per 100 milliliters or per 100
577grams;
578(D) not more than 2.5 milligrams of diphenoxylate and not less than 25
579micrograms of atropine sulfate per dosage unit;
580(E) not more than 100 milligrams of opium per 100 milliliters or per 100 grams;
581(F) not more than 0.5 milligram of difenoxin and not less than 25 micrograms of
582atropine sulfate per dosage unit; and
583(G) unless specifically exempted or excluded or unless listed in another schedule,
584any material, compound, mixture, or preparation which contains Pyrovalerone
585having a stimulant effect on the central nervous system, including its salts,
586isomers, and salts of isomers.
587(ii) A drug product or preparation that contains any component of marijuana,
588including cannabidiol, and is approved by the United States Food and Drug
589Administration and scheduled by the Drug Enforcement Administration in
590Schedule V of the federal Controlled Substances Act, Title II, P.L. 91-513.
591(iii) Gabapentin.
592   (3)(a) As used in this subsection, "pharmaceutical composition" means a drug that has
593United States Food and Drug Administration approval under 21 U.S.C. Sec. 355
594following clinical trials.
595(b) If the federal government schedules a pharmaceutical composition of a Schedule I
596controlled substance or a pharmaceutical composition of any form of a Schedule I
597controlled substance in a schedule that is not Schedule I, that pharmaceutical
598composition is deemed scheduled under this section in the same schedule that the
599pharmaceutical composition is scheduled under 21 U.S.C. Sec. 812 and 21 C.F.R.
600Part 1308.
601Section 2. Effective Date.
602   This bill takes effect on May 6, 2026.
