                                11   RELATING TO LOBBYING; REQUIRING A LOBBYING ACTIVITY REPORT ON
                                12   THE LEGISLATION LOBBIED AND POSITION TAKEN BY A LOBBYIST AND
                                13   LOBBYIST'S EMPLOYER; PRESERVING LOBBYING ACTIVITY REPORTS FOR
                                14   AT LEAST TEN YEARS.

                                16   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

                                17        SECTION 1.    A new section of the Lobbyist Regulation Act

                                18   is enacted to read:
                                19        "[NEW MATERIAL] LOBBYING ACTIVITY REPORT.--
                                20  A.   A lobbyist or lobbyist's employer that is
                                21   required to file an expenditure report pursuant to Section
                                22   2-11-6 NMSA 1978 or registration statement pursuant to Section
                                23   2-11-3 NMSA 1978 shall file a lobbying activity report with the
                                24   secretary of state that discloses the lobbyist's or lobbyist's
                                25   employer's lobbying activity on legislation that has been

                                1    introduced, including any lobbying on the development of
                                2    legislation prior to the legislation's introduction in a
                                3    legislative session, and that identifies the:
                                4  (1)   specific legislation lobbied;
                                5  (2)   lobbyist's and lobbyist's employer's
                                6    support, opposition or other position taken on the legislation;
                                7    and
                                8  (3)   name of the lobbyist's employer that
                                9    lobbied on the legislation, either directly or through the
                                10   registered lobbyist.
                                11  B.   The lobbying activity report shall be filed in a
                                12   format as prescribed by rule of the secretary of state within
                                13   forty-eight hours of commencement of the lobbying activity.
                                14  C.   The lobbying activity reported for each specific
                                15   piece of legislation shall be included or linked on the
                                16   legislature's website for that specific piece of legislation."

                                17  SECTION 2.    Section 2-11-7 NMSA 1978 (being Laws 1977,

                                18   Chapter 261, Section 7, as amended) is amended to read:
                                19  "2-11-7.     REGISTRATION, [AND] EXPENDITURE AND LOBBYING
                                20   ACTIVITY REPORT--PRESERVATION AS PUBLIC RECORD--ONLINE
                                21   REPORTS.--
                                22  A.   Each registration, [and] expenditure and
                                23   lobbying activity report as required by the Lobbyist Regulation
                                24   Act shall be archived and accessible on the secretary of
                                25   state's lobbyist disclosure website for a period of at least

                                1    ten years from the date of filing as a public record, open to
                                2    public inspection at any reasonable time.    Unless an action or
                                3    prosecution is pending that requires preserving the report, it
                                4    may be destroyed ten years after the date of filing.
                                5  B.   Lobbyist [registrations and] registration,
                                6    expenditure and lobbying activity reports shall be kept and
                                7    maintained on the secretary of state's lobbyist disclosure
                                8    website and shall be available in searchable and downloadable
                                9    formats.
                                10  C.   With respect to the secretary of state's
                                11   lobbyist disclosure website, all items in the records shall be
                                12   easily searchable, sortable and downloadable by the public to
                                13   the extent technically practicable.
                                14  D.   The secretary of state shall ensure that
                                15   contributions reported by persons pursuant to the Lobbyist
                                16   Regulation Act are reported in a manner that is nonduplicative

                                17   and as consistent as practicable with the reporting

                                18   requirements of the Campaign Reporting Act.    To the extent
                                19   possible, the electronic reporting system used for registration
                                20   and reporting required by the Lobbyist Regulation Act shall be
                                21   integrated with the electronic reporting system used for
                                22   compliance with the Campaign Reporting Act.
                                23  E.   Reporting individuals under the Campaign
                                24   Reporting Act shall receive automatic electronic notice of the
                                25   contributions to them reported by lobbyists and lobbyists'

                                1    employers within twenty-four hours of the filing of each
                                2    expenditure report."
                                3  SECTION 3.   EFFECTIVE DATE.--The effective date of the
                                4    provisions of this act is January 1, 2027.
