Synopsis: Use of telecommunications device while driving. Provides
that a person who knowingly or intentionally violates the statute
prohibiting use of a telecommunications device while operating a
moving motor vehicle commits a Level 5 felony if the violation is the
proximate cause of serious bodily injury to another person.
Effective: July 1, 2026.

                   HOUSE BILL No. 1391
   A BILL FOR AN ACT to amend the Indiana Code concerning
 motor vehicles.
     Be it enacted by the General Assembly of the State of Indiana:
1    SECTION 1. IC 9-21-8-60 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2026]: Sec. 60. (a) A person who knowingly or intentionally
4 violates section 59(a) of this chapter commits a Level 5 felony if the
5 violation is the proximate cause of serious bodily injury to another
6 person.
7    (b) The offense described in subsection (a) is a Level 4 felony if
8 the person has a previous infraction under section 59(a) of this
9 chapter in the five (5) years preceding the violation of subsection
10 (a).
11    (c) A person who violates subsection (a) commits a separate
12 offense for each person whose injury is caused by the violation of
13 subsection (a).
14    SECTION 2. IC 35-52-9.1-20.2 IS ADDED TO THE INDIANA
15 CODE AS A NEW SECTION TO READ AS FOLLOWS
16 [EFFECTIVE JULY 1, 2026]: Sec. 20.2. IC 9-21-8-60 defines a crime
17 concerning traffic regulation.
