Synopsis: Utility votes at RTO meetings. Beginning in 2027, requires
certain public utilities that provide electric utility service to file with
the Indiana utility regulatory commission (IURC) an annual report that:
(1) lists, or otherwise provides access to information on, each recorded
vote cast by the public utility, and any affiliate of the public utility, at
a meeting of the PJM Interconnection, LLC regional transmission
organization (RTO), regardless of whether the vote is disclosed by the
RTO; and (2) includes a brief description explaining how each vote
identified supports the provision of electric utility service with the
attributes set forth in Indiana's state energy policy. Provides that for
purposes of this requirement, a meeting means a meeting of: (1)
specified permanent standing committees of the RTO; or (2) any senior
task force of the RTO that is active during the calendar year with
respect to which a report is submitted by a public utility under the bill's
provisions. Requires the IURC to post on the IURC's website the
reports received under the bill's provisions. Requires the IURC to adopt
rules to implement these provisions.

                   HOUSE BILL No. 1434
     A BILL FOR AN ACT to amend the Indiana Code concerning
 utilities.
     Be it enacted by the General Assembly of the State of Indiana:
1    SECTION 1. IC 8-1-8.5-15 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2026]: Sec. 15. (a) The following terms apply throughout this
4 section:
5      (1) "Affiliate" means a person that directly, or indirectly
6      through one (1) or more intermediaries:
7(A) controls;
8(B) is controlled by; or
9(C) is under common control with;
10      a specified person. The term includes a parent company or a
11      subsidiary.
12      (2) "Meeting", with respect to the regional transmission
13      organization, means a meeting of the following:
14(A) The following permanent standing committees or their
15successors:
16(i) The planning committee.
17(ii) The operating committee.

1(iii) The market implementation committee.
2(iv) The risk management committee.
3(B) Any senior task force that is active during the calendar
4year with respect to which a report is submitted by a
5public utility under subsection (b).
6      (3) Notwithstanding section 1 of this chapter, "public utility"
7      means a utility that is:
8(A) listed in 170 IAC 4-7-2(a); and
9(B) a member of the regional transmission organization.
10      (4) "Recorded vote" means a vote that is tabulated, either
11      individually or as part of an industry sector, at a meeting. The
12      term does not include a vote in an election for one (1) or more
13      leadership positions on the board of managers or a committee.
14      (5) "Regional transmission organization" refers to the
15      regional transmission organization known as the PJM
16      Interconnection, LLC that operates the bulk power
17      transmission system serving parts of Indiana.
18    (b) Beginning in 2027, not later than February 1 of each year, a
19 public utility shall file with the commission a report, on a form
20 specified by the commission, that:
21      (1) lists, or otherwise provides access to information on, each
22      recorded vote cast by:
23(A) the public utility; and
24(B) any affiliate of the public utility;
25      at a meeting of the regional transmission organization during
26      the immediately preceding calendar year, regardless of
27      whether the vote is disclosed by the regional transmission
28      organization; and
29      (2) includes a brief description explaining how each vote
30      identified under subdivision (1) supports the provision of
31      electric utility service with the attributes set forth in
32      IC 8-1-2-0.6, including:
33(A) reliability;
34(B) affordability;
35(C) resiliency;
36(D) stability; and
37(E) environmental sustainability.
38    (c) Upon receiving a report from a public utility under
39 subsection (b), the commission shall post the report on the
40 commission's website.
41    (d) The commission shall adopt rules under IC 4-22-2 to
42 implement this section, including a rule prescribing the form to be
