1   A BILL FOR AN ACT relating to the Nebraska Affordable Housing Act; to
2amend section 58-701, Revised Statutes Supplement, 2025; to provide
3requirements for multifamily housing projects to receive assistance;
4to harmonize provisions; and to repeal the original section.
5    Be it enacted by the people of the State of Nebraska,

1Section 1. Section 58-701, Revised Statutes Supplement, 2025, is
2    amended to read:
358-701 Sections 58-701 to 58-712 and section 2 of this act shall be
4   known and may be cited as the Nebraska Affordable Housing Act.
5Sec. 2.      (1) For purposes of this section:
6(a) Accessible has the same meaning as in 24 C.F.R. 8.3, as such
7   regulation existed on January 1, 2026; and
8(b)   Multifamily    housing    project   means   a   project   involving   the
9   construction of one or more residential structures that, as a whole,
10    contain five or more dwelling units.
11(2) Beginning on the effective date of this act, the Department of
12    Economic Development shall not approve a multifamily housing project for
13    assistance from the Affordable Housing Trust Fund unless:
14(a) At least twenty percent of the dwelling units included in the
15    project will be accessible for persons with mobility impairments; and
16(b) At least ten percent of the dwelling units included in the
17    project   will    be   accessible   for    persons    with   hearing   or   vision
18    impairments.
19Sec. 3.      Original section 58-701, Revised Statutes Supplement, 2025,
20    is repealed.
