1   A   BILL   FOR   AN    ACT    relating    to   municipalities;   to    authorize    certain
2contracts       and    agreements   relating   to   parking     facilities;   and   to
3provide a duty for the Revisor of Statutes.
4   Be it enacted by the people of the State of Nebraska,

1Section 1.       (1) Any city of the first class, city of the second
2    class, or village may enter into contracts or agreements with any person,
3    firm,   corporation,      or     political   subdivision       for    the   operation,
4    maintenance, management, or enforcement of municipal parking facilities,
5    including onstreet metered parking and offstreet public lots or garages.
6(2) Such contracts or agreements may authorize the person, firm,
7    corporation,   or    political    subdivision    to   issue    and    process   parking
8    citations, collect fines, maintain equipment, or operate payment systems,
9    provided   that     the   city    or   village   retains      final   authority    over
10    adjudication and appeals.
11(3) The city or village shall retain sufficient control over the
12    parking facilities to ensure proper operation in the public interest and
13    to establish or approve all rates, charges, and fines.
14(4) No contract or agreement under this section shall exceed:
15(a) Thirty years in duration, including renewals, for a city of the
16    first class; or
17(b) Ten years in duration, including renewals, for a city of the
18    second class or village.
19Sec. 2.      The Revisor of Statutes shall assign section 1 of this act
20    to Chapter 19.
