3  LONG TITLE
4  General Description:
5      This bill removes the limit on the amount a safety inspection station can charge for labor in
6  performing a safety inspection.
7  Highlighted Provisions:
8      This bill:
9      ▸ allows safety inspection stations to charge a reasonable fee for safety inspections without
10  a statutory limit.

19  Be it enacted by the Legislature of the state of Utah:
20Section 1. Section 53-8-206 is amended to read:
2153-8-206 . Safety inspection -- Station requirements -- Permits not transferable --
22  Certificate of inspection -- Fees -- Unused certificates -- Suspension or revocation of
23  permits.
24  (1) The safety inspection required under this part may only be performed:
25      (a) by a person certified by the division as a safety inspector; and
26      (b) at a safety inspection station with a valid safety inspection station permit issued by
27the division.
28  (2)(a) A safety inspection station permit may not be assigned,[ or] transferred, or used at [

29any] a location other than a designated location.
30(b) The holder of a safety inspection station permit shall post the permit in a
31conspicuous place at the location designated in the permit.
32   (3) If required by the division, the safety inspector shall keep a record and file a report of
33every safety inspection and every safety inspection certificate issued.
34   (4)(a) A safety inspection station holding a safety inspection station permit issued by the
35division may charge a reasonable fee for labor in performing safety inspections[, not
36to exceed:] .
37[(a) $14 or less for motorcycles and street-legal all-terrain vehicles;]
38[(b) unless Subsection (4)(a) or (c) applies, $30 or less for motor vehicles; or]
39[(c) $40 or less for 4-wheel drive, split axle, and any motor vehicles that necessitate
40disassembly of front hub or removal of rear axle for inspection.]
41(b) A safety inspection station charging a fee as described in Subsection (4)(a) shall
42conspicuously post the fee amount before performing a safety inspection.
43   (5)(a) A safety inspection station may return to the division unused safety inspection
44certificates in a quantity of 10 or more.
45(b) The division shall reimburse the station for the cost of the returned safety inspection
46certificates.
47   (6)(a) Upon receiving notice of the suspension or revocation of a safety inspection
48station permit and after the conclusion of [any] an adjudicative [proceedings]
49proceeding upholding the suspension or revocation, the safety inspection station
50permit holder shall:
51(i) immediately terminate all safety inspection activities; and
52(ii) return all safety inspection certificates and the safety inspection station permit to
53the division.
54(b) The division shall issue a receipt for all unused safety inspection certificates.
55Section 2. Effective Date.
56   This bill takes effect on May 6, 2026.
