1 AN ACT concerning the department of health and environment office of
2   vital statistics; relating to information regarding government-
3   administered savings accounts; establishing the born to invest act;
4   requiring the office of vital statistics to provide information regarding
5   children born in Kansas to the state treasurer; permitting the state
6   treasurer to provide informational materials on government-
7   administered savings accounts for such children and such children's
8   families.

10 Be it enacted by the Legislature of the State of Kansas:
11    Section 1. (a) This section shall be known and may be cited as the
12 born to invest act.
13    (b) (1) The state treasurer shall determine the data necessary to
14 distribute informational materials that describe the availability, purposes,
15 advantages and enrollment procedures concerning:
16    (A) For a child born on or after January 1, 2025, a Trump account
17 established by section 530A of the federal internal revenue code;
18    (B) the postsecondary educational savings program established by
19 section 529 of the federal internal revenue code and K.S.A. 75-640
20 through 75-648, and amendments thereto; and
21    (C) an ABLE savings account established by section 529A of the
22 federal internal revenue code and K.S.A. 75-651 through 75-657, and
23 amendments thereto.
24    (2) The data may include the:
25    (A) Name of the child;
26    (B) name and mailing address of the child's parent or legal guardian
27 on the child's certificate of live birth; or
28    (C) date of the child's live birth.
29    (c) (1) Notwithstanding any other law to the contrary, the state
30 registrar of vital statistics shall provide to the state treasurer the data
31 determined necessary under subsection (b).
32    (2) (A) By September 1, 2026, if no corresponding death certificate
33 has been issued for a child, the state registrar of vital statistics shall
34 provide to the state treasurer data relating to children in Kansas who were
35 born prior to July 1, 2026, and are currently eligible for government-

1 administered savings accounts.
2     (B) Within 90 days after the issuance of a certificate of a live birth of
3 a child in Kansas, unless a corresponding death certificate has been issued
4 for the child within such time, the state registrar of vital statistics shall
5 provide to the state treasurer the data relating to children born in Kansas
6 on or after July 1, 2026.
7     (3) The data shall be transmitted in a secure electronic manner
8 consistent with applicable federal and state law.
9     (d) The informational materials shall be in a suitable form and
10 manner as prescribed by the state treasurer for mail, including brochures,
11 letters, inserts or other printed information. The state treasurer may share
12 information and materials with the department of administration division
13 of printing for the printing, production and distribution of the
14 informational materials.
15     (e) The state treasurer shall maintain information regarding the
16 availability, purposes and advantages of the government-administered
17 savings accounts described in subsection (b). To ensure that Kansas
18 families are aware of the accounts, the state treasurer shall publicize the
19 information on the state treasurer's website and through financial literacy
20 educational training.
21     (f) The secretary of health and environment and the state treasurer
22 may enter into interagency agreements to carry out this section. The
23 agreements may address procedures, confidentiality, data transfers,
24 reimbursements of actual costs and any other matters determined
25 necessary by the secretary and state treasurer.
26     (g) Except as permitted by state or federal law and the purposes of
27 this section, nothing in this section shall be construed to authorize the
28 disclosure of any confidential or protected records or information.
29     Sec. 2. This act shall take effect and be in force from and after its
30 publication in the statute book.
