s235/introduced.txtBILL AS INTRODUCED S.2352026 Page 1 of 41S.2352 Introduced by Senator Westman3 Referred to Committee on4 Date:5 Subject: Commerce and trade; consumer protection; motor vehicles; service6history; defects; disclosure7 Statement of purpose of bill as introduced: This bill proposes to require motor8 vehicle dealers and repair shops to provide accurate information regarding a9 motor vehicle’s service history and diagnostics to vehicle history information10 databases and providers, and to require dealers to disclose vehicle history11 information in the dealer’s possession to a prospective purchaser.12 An act relating to the reporting and disclosure of motor vehicle diagnostics13 and service history14 It is hereby enacted by the General Assembly of the State of Vermont:15 Sec. 1. 9 V.S.A. chapter 63, subchapter 13 is added to read:16Subchapter 13. Motor Vehicle Service History17 § 2495. DEFINITIONS18 As used in this section:19(1) “Dealer” means a person engaged in the business of selling or20 exchanging new or used motor vehicles, or both. A dealer includes any personVT LEG #385981 v.1BILL AS INTRODUCED S.2352026 Page 2 of 41 that, as part of or incidental to such business, repairs motor vehicles, sells2 motor vehicle parts and accessories, or leases or rents motor vehicles.3(2) “Repair shop” means a person that is engaged in the business of4 performing service or maintenance on motor vehicles but is not a dealer.5(3) “Vehicle history database” means a database from which a person6 may obtain vehicle history information specific to a vehicle identification7 number (VIN).8(4) “Vehicle history information” includes the following related to a9 motor vehicle:10(A) accident or damage information;11(B) the number of previous owners;12(C) information regarding service or maintenance history, including13 diagnostic information generated while performing service or maintenance;14(D) odometer reading; and15(E) title information.16(5) “Vehicle history report” means any written or electronic17 communication of vehicle history information made by a vehicle history report18 provider that is made available to consumers.19(6) “Vehicle history report provider” means an entity that generates20 vehicle history reports from a vehicle history database that are provided21 directly to consumers. “Vehicle history report provider” does not include aVT LEG #385981 v.1BILL AS INTRODUCED S.2352026 Page 3 of 41 dealer that obtains a vehicle history report from a third party that is not an2 affiliate of the dealer and that then communicates the vehicle history report3 without altering the vehicle history information in the report.4 § 2495a. REPORTS TO VEHICLE HISTORY REPORT PROVIDERS5 In any instance in which a dealer or repair shop provides information6 regarding a motor vehicle to a vehicle history report provider or other entity7 that maintains a vehicle history database, the dealer or repair shop shall8 provide accurate information regarding the motor vehicle, including any9 repairs, services, or maintenance performed on the vehicle and the results of10 any diagnostics performed on the vehicle.11 § 2495b. DISCLOSURE OF USED VEHICLE HISTORY INFORMATION12TO PROSPECTIVE PURCHASERS13 A dealer shall disclose to a prospective purchaser of a used motor vehicle14 any vehicle history information related to that motor vehicle that is in the15 possession of the dealer, including any vehicle history reports that the dealer16 has obtained and any other vehicle history information that is in the possession17 of the dealer or is readily available to the dealer.18 § 2495c. VIOLATIONS19 (a) A violation of this subchapter is deemed to be a violation of section20 2453 of this title.VT LEG #385981 v.1BILL AS INTRODUCED S.2352026 Page 4 of 41 (b) The Attorney General has the same authority to make rules, conduct2 civil investigations, enter into assurances of discontinuance, and bring civil3 actions, and private parties have the save rights and remedies, as provided4 pursuant to subchapter 1 of this chapter.5 Sec. 2.
