1A bill to be entitled
2An act relating to trust funds; creating s. 267.23,
3F.S.; creating the Historic Cemeteries Trust Fund
4within the Division of Historical Resources of the
5Department of State; providing the purpose of the
6trust fund; requiring that moneys be deposited into
7the trust fund and disbursed by the division as
8provided in a specified provision; requiring that any
9balance at the end of the fiscal year remain in the
10trust fund for a specified purpose; providing for
11future review and termination or re-creation of the
12trust fund; providing a contingent effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16Section 1.       Section 267.23, Florida Statutes, is created to
17read:
18267.23      Historic Cemeteries Trust Fund.—
19(1)     The Historic Cemeteries Trust Fund is created within
20the division. The purpose of the trust fund is to act as a
21depository for the long-term maintenance and upkeep of
22cemeteries under the Historic Cemeteries Program.
23(2)     Moneys must be deposited into the trust fund and
24disbursed by the division as provided in s. 267.21.
25(3)     Notwithstanding s. 216.301 and pursuant to s. 216.351,

26    any balance in the trust fund at the end of any fiscal year must
27    remain in the trust fund at the end of the year and must be
28    available for carrying out the purposes of the trust fund.
29(4)     In accordance with s. 19(f), Art. III of the State
30    Constitution, the Historic Cemeteries Trust Fund, unless
31    terminated sooner, shall be terminated on July 1, 2030. Before
32    its scheduled termination, the trust fund must be reviewed as
33    provided in s. 215.3206(1) and (2).
34Section 2.       This act shall take effect on the same date
35    that HB 425 or similar legislation takes effect, if such
36    legislation is adopted in the same legislative session or an
37    extension thereof and becomes a law.
