sb45/introduced.txtSB45 INTRODUCED1 SB452 ZQSCDKR-13 By Senator Elliott4 RFD: State Governmental Affairs5 First Read: 13-Jan-266 PFD: 09-Jan-26Page 0ZQSCDKR-1 09/08/2025 THR (L)THR 2025-26441234 SYNOPSIS:5Under existing law, individuals are required to6obtain a driver license before driving a motor vehicle7in this state, and new residents are required to obtain8an Alabama driver license within 30 days after9establishing residence in this state.10A nonresident with a driver license issued in11his or her home state or country may be exempt from the12Alabama driver license requirement under certain13circumstances.14This bill would invalidate the use of any driver15license that explicitly indicates it was issued to an16individual who did not exercise the option of providing17proof of lawful presence in the United States when18obtaining the license.19This bill would also prevent a nonresident from20qualifying for an exemption to the Alabama driver21license requirement if the nonresident's license22explicitly indicates that it was issued to an23individual who did not exercise the option of providing24proof of lawful presence in the United States when25obtaining the license.262728A BILLPage 1SB45 INTRODUCED29TO BE ENTITLED30AN ACT3132Relating to driver licenses; to invalidate the use of33 certain classes of driver licenses; to amend Section 32-6-2,34 Code of Alabama 1975; to prevent certain individuals from35 qualifying for certain driver license exemptions.36 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:37Section 1. (a) A driver license of a class issued38 exclusively to individuals who did not exercise the option of39 providing proof of lawful presence in the United States when40 obtaining the license is not valid in this state and does not41 authorize the holder to operate a motor vehicle in this state.42(b) A law enforcement officer who stops an individual43 driving with a license as described in subsection (a) shall44 issue a citation to the individual for driving without a45 license pursuant to Section 32-6-18, Code of Alabama 1975.46(c) To facilitate the enforcement of this section and47 to aid in providing notice to visitors and the general public48 concerning invalid driver licenses, the Alabama State Law49 Enforcement Agency shall do both of the following:50(1) Maintain on its website a statement summarizing51 this section.52(2) Design road signage to give notice to drivers53 regarding the provisions of this section.54(d) The State Department of Transportation shall55 install the signage designed pursuant to subsection (c) in56 each location that features a sign welcoming drivers to thisPage 2SB45 INTRODUCED57 state.58Section 2. Section 32-6-2, Code of Alabama 1975, is59 amended to read as follows:60"§32-6-261The following persons individuals, when driving a motor62 vehicle under the following conditions, are exempt from a the63 requirement to obtain a driver license hereunder:64(1) Any person individual in the service of the federal65 government while driving an official motor vehicle in such66 service;.67(2) Any person individual while driving any road68 machine, farm tractor, or implement of husbandry temporarily69 driven or moved on a highway;.70(3) A nonresident who is at least 16 years of age and71 who has in his or her immediate possession a valid driver's72 driver license issued in his or her home state or country;.73 This exemption shall not apply if the nonresident's license is74 invalid pursuant to Section 1 of the act amending this75 section.76(4) Any nonresident who is at least 16 years of age77 whose home state or country does not require the licensing of78 drivers for a period of not more than 90 days in any calendar79 year, if the motor vehicle so driven is duly registered in the80 home state or country of such nonresident."81Section 3.
