4 SYNOPSIS:
5Under existing law, individuals are required to
6obtain a driver license before driving a motor vehicle
7in this state, and new residents are required to obtain
8an Alabama driver license within 30 days after
9establishing residence in this state.
10A nonresident with a driver license issued in
11his or her home state or country may be exempt from the
12Alabama driver license requirement under certain
13circumstances.
14This bill would invalidate the use of any driver
15license that explicitly indicates it was issued to an
16individual who did not exercise the option of providing
17proof of lawful presence in the United States when
18obtaining the license.
19This bill would also prevent a nonresident from
20qualifying for an exemption to the Alabama driver
21license requirement if the nonresident's license
22explicitly indicates that it was issued to an
23individual who did not exercise the option of providing
24proof of lawful presence in the United States when
25obtaining the license.

32Relating to driver licenses; to invalidate the use of
33 certain classes of driver licenses; to amend Section 32-6-2,
34 Code of Alabama 1975; to prevent certain individuals from
35 qualifying for certain driver license exemptions.
36 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
37Section 1. (a) A driver license of a class issued
38 exclusively to individuals who did not exercise the option of
39 providing proof of lawful presence in the United States when
40 obtaining the license is not valid in this state and does not
41 authorize the holder to operate a motor vehicle in this state.
42(b) A law enforcement officer who stops an individual
43 driving with a license as described in subsection (a) shall
44 issue a citation to the individual for driving without a
45 license pursuant to Section 32-6-18, Code of Alabama 1975.
46(c) To facilitate the enforcement of this section and
47 to aid in providing notice to visitors and the general public
48 concerning invalid driver licenses, the Alabama State Law
49 Enforcement Agency shall do both of the following:
50(1) Maintain on its website a statement summarizing
51 this section.
52(2) Design road signage to give notice to drivers
53 regarding the provisions of this section.
54(d) The State Department of Transportation shall
55 install the signage designed pursuant to subsection (c) in
56 each location that features a sign welcoming drivers to this

58Section 2. Section 32-6-2, Code of Alabama 1975, is
59 amended to read as follows:
60"§32-6-2
61The following persons individuals, when driving a motor
62 vehicle under the following conditions, are exempt from a the
63 requirement to obtain a driver license hereunder:
64(1) Any person individual in the service of the federal
65 government while driving an official motor vehicle in such
66 service;.
67(2) Any person individual while driving any road
68 machine, farm tractor, or implement of husbandry temporarily
69 driven or moved on a highway;.
70(3) A nonresident who is at least 16 years of age and
71 who has in his or her immediate possession a valid driver's
72 driver license issued in his or her home state or country;.
73 This exemption shall not apply if the nonresident's license is
74 invalid pursuant to Section 1 of the act amending this
75 section.
76(4) Any nonresident who is at least 16 years of age
77 whose home state or country does not require the licensing of
78 drivers for a period of not more than 90 days in any calendar
79 year, if the motor vehicle so driven is duly registered in the
80 home state or country of such nonresident."
81Section 3. This act shall become effective on October
82 1, 2026.
